Hi, In February I paid for goods brought via a classifieds website, I spoke to the person selling the goods via email numerous times and eventually decided to purchase. He said he didn't have a paypal account and so I did a bank transfer. I still haven't recieved the goods and now he is ignoring my emails. Does the Section 75 cover bank transfer too?? I wouldn't have to goto a small claims court or anything would I? I don't know the persons address or anything, only that they live in Perth in Scotland. I have contacted classifieds website but they can't get hold of the person either.
Any suggestions??
Thanks0 -

We have been told by other purchasers that they claimed the reservation fee of 3000 euros back from their credit card company. Our problem is that we no longer have any credit cards, we have the card number we paid with on a receipt, but we can't remember which credit card provider this was with. Does anyone know how we can find out which company this was?
If you ring the Financial Ombudsman on 08000 234567 option 3. They are very helpful and if you give them the credit card number they should be able to tell you which company it was and where to write to. The first 6 digits are the identifier I think.Total claimed so far....over £40k! All for friends and relatives, who needs claim companies when we've got Martin!0 -
I am in the process of making a Section 75 claim with Marbles. They asked for receipts, etc, etc, I sent them everything they asked for. I received a very nice letter stating that they had consulted their legal team and were advised that they had no case to answer! No mention in the letter about complaints procedures! I phoned the Financial ombudsman for advice, they were brilliant, they are sending me an information pack. If I get bogged down with Marbles at any time during the complaints procedure, they said that they will take it on on my behalf. I'll keep you posted.Total claimed so far....over £40k! I had some vinyl tiling completed by a carpet company which we are not happy with (the floor preparation and fitting). I have had another expert look at it. He has said they gave us incorrect advice originally and also they did not complete the job with due care and attention. (Quick job by an under pressure fitter)
I have complained to the company and they say the job is ok and they will not do anything.
I am seeing if their regulator will look at this first, before going to the county courts. But will I be able to make a claim under Section 75 as I paid the £400 by credit card? Also what order should I pursue this. Regulator, Section 75 then county courts?

Yes you can! Interest is treated as frontline profit to banks so they usually don't kick up a fuss if you ask for it back following a dispute (if you are successul with the claim). A lot of banks will now stop interest accruing when you raise the dispute with them. It's always worth bearing in mind that if you took this matter to a court (and won, then they would award you with interest (usually 8%). It maybe worth mentioning that to Barclays0 -

Yes you can. I would ask the third party expert to put his views in writing for you as this will support your claim. I would suggest that you should claim under Section 75 initially as you will not incur court costs etc.0 -

If they have asked for the contract I am pretty sure you will need to send them it, or a copy, can't you ask Cartel Client review for a copy?
Why are you attempting a S75 claim? Have they not carried out the review?Don`t steal - the Government doesn`t like the competition0
