    Hi,

I'm currently embroiled with Nationwide, making a claim back under section 75 for a car I bought from a garage which was sold as roadworthy (they put a new mot on it as well!).
I have since discovered it is largely bereft of back brakes...but that's another story.

Nationwide are giving me the run around at the moment, I am due to pay the balance on my credit card (including the disputed transaction) by May 15th.
Should I pay off my balance in full, or as I am raising a dispute and at present they have not supplied me with a 'final letter' am I within my rights not to pay that portion of the outstanding balance?

    thanks

    Nick.

I think you will need to supply the CC company with some more info than just a statement.

They will need to know if they are liable under S75 for your claim, you cannot expect them to chase the receiver, who will not give them any details re the DPA.

Can you not contact the receivers?
There must be a contact for them.

I can't see any point trying to contact Cartel, ( if that is who you are calling and emailing), if they are in liquidation!
Are they in liquidation or receivership?

  • Can anyone advise on whether s.75 cover would apply where a holiday booking has been made, but one of the party going has passed away? I appreciate most would first look at travel insurance but this will not apply in this case.
    Thanks

I am in the process of making a Section 75 claim with Marbles. They asked for receipts, etc, etc, I sent them everything they asked for. I received a very nice letter stating that they had consulted their legal team and were advised that they had no case to answer! No mention in the letter about complaints procedures! I phoned the Financial ombudsman for advice, they were brilliant, they are sending me an information pack. If I get bogged down with Marbles at any time during the complaints procedure, they said that they will take it on on my behalf. I'll keep you posted.

The information pack contained the name and address of the correct person to complain to at Marbles (Bank of Scotland), I did that, he too said as I had closed the account then Section 75 does not apply and they have no case to answer. I am now making a formal complaint before going back to the ombudsman.
Total claimed so far....over £40k! All for friends and relatives, who needs claim companies when we've got Martin!

Hi, Without wishing to sound disrespectful, the credit card company and holiday company are not responsible for the passing of the party member... Section 75 will not apply.

    All the best

Does anyone have any experience of getting compensation for time wasted when making a complaint against a financial institution S.75 claim through the Ombudsman?

I am in the middle of a claim against a company which has been dragging out my original dispute since last summer, and although now with the Ombudsman, it would be interesting to hear if other people have had success in claiming compensation for lost time.
I am talking about an unbelievable (just worked this out and was shocked) 600 hours approx of time lost due to the subject of the claim!

Sect 75 & Volcanic Ash Holiday Chaos
Travel insurance companies are now declining claims for lost holidays if travel insurance was taken out after April 14. The holiday in question is Fly/Cruise booked directly with the cruise company & not a travel agent and paid in full by credit card.
Whilst the flight portion will be covered by the atol carrier & any out of pocket expenses by EU regulations I am wondering what would be the best way of recouping the balance of the cost of the cruise. Would a claim under Sect 75 against the credit card company be succesfull, particularly if payment was made prior to April 14?

    Credit card money transfers covered?

I am about to purchase some good from a supplier abroad and can pay direct in to their business account using my credit card from mint. They state the following on their website ...
'Please note that these payments will be treated as money transfers so there is no interest free period.'
However would I still be covered by section 75 if I didn't receive the goods for one reason or another as I am assuming this is still a credit card purchase?

When my son-in-law had been out of work for some months due he decided to retrain as a driving instructor. Having signed up to a training school he needed to pay his fees which I said I would do on my credit card as obviously he didn't have the money himself. Unfortunately the driving school went bust before he'd received any of the promised training.
I've made a claim under Section 75 but the credit card company are rejecting the claim as the contract with the driving school was with my son-in-law and not me.
Do I have any chance of success? I'm hoping I can persuade them it was a gift - which I assume should be covered.
    Any advice welcome.
