I purchased a kitchen from MFI just before they went into administration at their too good to miss out on 70% off (or not as it happened to be). Given that they had been in financial difficultly before, my sister paid on her CC for the full amount.
A claim under section 75 was made to RBS mid-December but after several calls they got round to processing on 16 January. A credit was made to the card but they were asked to refund and agreed to send a chq. When that didn't arrive two weeks later we were told that they had to retain the chq for 14 days, but another chq had been 'sent' ... you guessed it it has not arrived a further two weeks later.
Today my sister was told that they would only be able to send a chq or credit her bank account 45 days after the claim was logged so MFI could dispute it, despite being able to spend the money on her credit card. Is this correct?

I have the same query - today I have contacted my credit card company quoting Section 75 of the Consumer Credit Act & after taking & confirming details of when the payment was made on my credit card, I was told that the matter would be passed to their charge back team & that I should hear back from them within 14 days. Are you covered under section 75 for transactions that were done more than six months ago?
What about a scenario where flights were paid for on a credit card but you were unable to take the flight. Can you claim under section 75 in this situation?

To cut a very long story short we were stopped by scratchcard touts in Tenerife last May and joined a Holiday Club (CCC) but after signing the contract we realised the people we signed with were not the club themselves but an agent (HE). We were told certain things which enticed us to sign but were not actually included in the written contract. Like we would receive the whole of the amount of the money back in three years through a Cashback Scheme (CE).
We now know that this is a scam and have tried reclaiming the amounts paid on two different credit cards. Whilst I have received half of my amount back my husband has not had any co-operation with his bank and both credit card companies are really dragging this out. We have quoted section 75 but all we get is that it has been passed to the legal team.
We were told originally that each credit card company technically should be responsible for the full amount.
What chance have we got of getting anything back when we signed with HE but the contract was with CCC and we have not heard a thing about the cashback.
Can anyone help please, it was a large amount and the whole affair is making my life a misery.0 -

Does section 75 cover repairs to a vehicle where the bill is comprised of parts and labour.
I had an intermittent starting problem with my car. I took my car to the garage, they diagnosed it, supposedly fixed it and a couple of days later the same fault appeared. I took the car back and they have now apparantly fixed it, say it was something else and now want paying again.0 -

I had a flight booked however, I could not go due to work commitments. The airline has refused to give me a refund as they said the flight was on offer and I'm not entitled to a refund however, as I paid GBP800 for this flight and it was only slightly discounted from the normal standard price of the ticket. Do I have any rights to persue the amount of money I paid for this flight either from the airline or the credit card company?? I feel it is a lot of money to lose.

No way you will get a refund unless the airline offer one as a goodwill gesture.
It is not their fault you had work commitments, the flight was there for you to take, they did not withdraw it or put any restrictions on it , you could not use your ticket. Sorry but that is how it is.Don`t steal - the Government doesn`t like the competition0 -
I'm in the middle of a claim. The leading article in MoneySavingExpert says you are only covered for £100+, you are not covered for p&p, and that transactions with third parties such as PayPal are excluded. I'm finding this isn't the case. My transaction totalled less than that, included p&p and was paid to PayPal. I'm given every indication that my claim will be successful.0

Hi all MSE's,
I saw atrade advert for a car on E-bay. Because the deal involved paying all the money up front, I rang trading standards. They advised me to at least pay a £100 deposit on my credit card. I then sent £165 deposit to the firm through THEIR pay-pal account. I then paid the remaining balance by direct bank transfer into their bank account.
Now things have gone wrong and I didn't get the car on time. Eventually they tell me things beyond their control have happened so they will pay me back at a given amount per month.
I thought of going to my credit card firm and asking for the WHOLE of my money back from them, but here's the snag, because I paid through pay-pal it's considered a third party.
I phoned various legal helplines and have even e-mailed the Financial Ombudsman (who hasn't replied yet) I still have no definative answer.
Does anyone know the answer?Peter.
