hopefully somebody may be able to advise on the following/
I made a reservation for a property that was to be built and completed in 2011. The property was an apartment in 30-odd story high rise.
The deposit/reservation fee was 5% which came to around 10k
the first 2k I paid by credit card and the remainder by bank transfer.
Now the property is not being built because of the current economic climate. The provider is refusing to refund any of the depositors and trying to force them to take other apartments in a different city!
I read the section 75 rules in the article here. It does state land is not covered although this purchase is not for land. It also says purchases up to 30k are covered, the amount of claim is of course less than 30 but the overall apartment value if it had been built would have been in excess of 200k.
Is there a case under the section 75 for such a purchase?

I bought a bedroom from MFI, cash deposit of £500 but the remaining £2k on credit card. The bulk of it was delivered and installed but a couple of significant bits didn't turn up and now they've gone bust.
I put in a claim with the credit card company and they wrote back saying that as I'd had partial service I wasn't eligible to pursue a full refund but if I get quotes for someone to finish the work they'll 'give it their full attention'.
The issue is that no-one will be able to match the furniture for design, style, colour, finish or anything else, so even if I get quotes for someone to finish it off, it'll never be right, and I'll end up with a £2.5k fitted bedroom that doesn't match. I'll also need my new carpet replacing because it's cut to fit around the existing furniture and there's a good chance anything else will be a different size, and the same goes for wallpaper.
Basically it's a nightmare of biblical proportions!
So the question is, can I still pursue the claim for the full amount? In my opinion, what I need is to have what's there ripped-out, have the walls etc. made good and then buy something else from a different supplier and have that fitted in its place but I can't envisage me getting any joy on that unless the law is on my side.
So, does anyone know the answer? What does anyone think? Does anyone actually answer these questions?0 -

the martins weekly emails do make sense and i got out of bed this morning thinking, what about section 75 for a refund back
my scenario is that i foolishly now realise what i have done but im having to deal with all the consequences
i paid my friends mortgage arrears with my credit cards so that they didnt get evicted and also so that their taxi could nt be taken away taking away their livlehood
however, im now left with the debts as they cannot afford the full payments and my credit file is very bad now
ive requested cca's from the credit card companies but i wonder if you knowledgeable people have come across this - the mortgage company happily accepted my credit card payments but do i have any redress as the owner of the property ive paid to hasnt paid me back my money??
i know its a dark shot in the mess but im really at my wits end now, getting threats of my sale of my home due to helping others out
im so scared this could affect my marriage now pls pls help, its a been a bad day so far today, otherwise what other options can anyone think of
what a very hard lesson to learn, also they now could be repossessed again if they dont get a new mortgage, ive thought of a charging order but doesent help me in the short term, any legal bods on what i could do to show my interest in the property as until my credit cards are paid off>?

Hi, thanks for that information........I'm not sure if it is classed as a package holiday! We booked through Travel Republic, chose our flight first, then added accommodation (which we still have booked and have since found an alternate flight with Thomas Cook). The confirmations for both came through as separate items, so I have an invoice purely for flights from Freedom Flights (XL) and another confirmation mail for the accommodation......Can you give my your thoughts please? I'm holding off filling in the ATOL forms but really I need to get it moving as it's not just my money, I booked on behalf of myself and 5 friends and would really like to get their/my money back! Thanks for any input you can give me! <Frustrated and slightly confused!0

Hi there, I bought jewellery whislt abroad and found out upon my return the gem was not correct therefore the value had halved. Attempted to speak with them but they won't respond. Can I claim under this act?? Sarah x

Where can I get a copy of the Visa debit card charge back rules from?My bank refuses to let me see them as they tell me that it is because it is a " confidential agreement between themselves and Visa Europe"I am currently trying a DSAR to obtain them.0

Strangely,it is much easier to find information on charge back procedures for Visa for transactions in the USA than it does for UK ones.However I would imagine the criteria for determining the causes would be very similar.
They can be found by typing Visa charge back reason codes into Google0 -
