  • We immediately contacted our cr card (Tesco) when XL went bust the week before we were due to go to Las Vegas (September 08). We sent all documents and quoted Section 75 of Consumer Credit Act. We had an acknowledgement from them and spoke to them on the phone, they said no problem we will get our money back but due to the volume of claims it might take a while. Now it is almost 3 months later and we have not had our refund, we contacted them again today and they said they have to wait till 5th December to see what is going to happen and cannot tell us anything until after then. We again quoted Section 75 and said that they are liable to refund us and any issue they have with the administrators is their business, but they just told us the cannot say anything until after the 5th so there is no point us continuing the discussion! I thought we were covered firstly through ATOLL, then we were told to contact Cr Card Company if we paid by cr card, now they are dragging their heels!
  • After making a successful claim for a deposit amount of a package holiday can I now make a claim for the full amount (less the deposit)? I didn't realise this covered the full amount of the purchase.
  • Hi

Please could you advise if you can still make a claim under section 75 from a credit card company if you have purchased a course of treatments and have used some of the treatments prior to the company ceasing trade. Also should you apply for a full refund or only the equivalent to treatments not received.

    Thanks

Contact the cc company-would have thought you stand a good chance of getting some of it back.
  • We have just gained planning permission to build an extension.
Please would you clarify whether we can use a credit card to make staged payments to the building contractor, and if so, whether these payments would be covered under section 75 if the contractor were to go bust.
  • Can I make a Section 75 claim against my credit card company if I have closed my account?

Presumably I should always pay on ebay via paypal up to £100, but what about over that amount? Does paypal have any advantages over s75 CC Act cover?
