Yes, first they wanted to do charge back but told me I would have no hope of getting that without written proof of a manufacturing defect and that I would be liable for all the costs in attaining that proof plus postage, my time etc. So I asked to go through section 75 and they again told me I needed to attain proof first, but I could, in theory, claim back those expenses incurred.
Aside from the costs, finding any company willing to supply written proof of faulty goods is a real struggle, no one wants to even look at them. Even CAB says don't bother, it's going to cost me more time and money than I will see back0 -
My gut feeling, then, is to put in a complaint with Tesco.
With an S75 they should have the same responsibilities as the retailer.
As you say, it is up to the retailer to prove they are not faulty.0 -
That's the rub, it only states that explicitly in the sale of goods act and I can't seem to ascertain whether the shared responsibilities also implys the credit card company are bound in the same way by the sales of goods act as the retailer0

Hi Everyone this is my first post. This week I sent my claim form off to Barclaycard for a claim under Section 75 of the Consumer Credit Act. I wonder how long they will take to get back to me? Anyone out there who has done this who knows? The claim is for £10,000. I've used the MSE template letter so thanks for that.0

I need some advice. I have got to the stage of a Section 75 claim where Capital One have written to the store where I bought 2 chairs and acknowledged that "it has been established that there has been a breach of contract and/or a misrepresentation either prior to or at the point of sale, a valid Section 75 claim exists and either you, as the supplier of the goods, or us, as a credit card provider, will be required to settle the matter in full with the customer"
Capital One are now saying I need to consider the derisory remedy offered by the store to accept a totally different model of chair and that they would no longer entertain a full refund which is what I have asked for.
Where do I go now?

Will Section 75 protect me in the following situation?
Someone on facebook is selling something which he offers buyers to collect. I'm too far & suggested paypal. He says he can do part cards as he has a card machine that accepts payments into a escrow account.
It sounds like it might be dodgy, but if section 75 will protect me it might be worth a punt?0 -
I would have thought that an escrow arrangement wouldn't be covered by Section 75 in the same way that Paypal isn't - i.e. there is no direct link between purchaser, credit card company and supplier.
But I may be wrong.0 -

Is there such a thing as making a section 75 claim against your loan company?
I bought sofas from furniture company, was sold extended warranty however, 2 years after purchase I tried to claim insurance, and was told there's no way sofas would have been covered because of foam! And I'm out of original manufacters warranty.

I am a newbie here and I am confused. I wonder if anyone can help. I bought a Polti Evolution steam cleaner from Go Electricals for about £200 in Nov 13 and paid by Amex. The machine had 2 year guarantee. In Feb14 the machine would not come on, hence contacted Go Electrical, who arranged repairs thru Polti as the machine was only about 3 months old. This machine is only used very sparingly. Last month the machine did same again and would not come on and I believe it is the same problem.
I emailed Go Electrical explaining and they said it is outside guarantee, but still liaised with Polti who refused any help but said they can repair but would cost 100 pounds. Polti it seems don't believe in any goodwill etc.
I just wonder I have any grounds to make a claim, if under what category. Apologies if this is the wrong thread. Please point in right direction. Thanks in advance.0
