just to say to all those that have been able to retrieve their charges back well done i recently sent a letter to my bank to get the to refund my charges and they declined stting that i was my fault that i hadnt conducted my account within the terms and agreement of the condition of the account and that they sought their legal depatment explaining that the charges are a 'genuine' pre-estimated of their loss and that they are legally enforcable, has anyone sent a second letter to try to recieve or have you gone straight to the trading standards0

vikkyedwards: Re claiming my charges from the Co-op. I wrote explaining that the charges levied on my account are unenforceable as punitive fines for breach of contract are not recognised in law. I totalled up the charges made over the six year period and wrote telling them that unless I receive full payment within 7 days I would commence legal action for recovery plus costs and interest. They replied saying they needed 21 days and could not reply in 7. The 21 days expire on Friday. If they have not responded with payment I will issue a final demand, with another 7 day limit. If that is not paid I will commence action through the small claims court without any further notice.

Everyone is talking about the banks and cc companies being unfair, and this may well be true. However, what worries me is that they are the lenders and I am sure that it states in their terms that they have the right to call in the oustanding balance at any time. Get nasty with them and they could get nasty with you. Once this got out on this web site, I think that people's attitude to reclaiming charges with the threat of suing would quickly change. I have no sympathy with the banks, but in the end they may hold the upper hand.0
