    And if I'd offered to remove those clauses from the T&C's???

    Show me a bank or CC company that hasn't got those charges in their t&c's. For this reason alone the terms are unfair, and not legally enforcable; couple that with the Unfair Terms in Consumer Contracts regulations and frankly the charges become only slightly more legal than burglary.

    Sounds to me like cowardice - take it on the chin indeed. Methinks someone hasn't the bottle to fight against unfair and dubious legality of the charges.
  • Just like to say, thanks to dchurch, I am taking Co-Op Bank (who must be the least co-operative bank I have ever heard of) to task of £1300 of charges over the last 6 years. Will keep posted via this site.

    What if you fall i'll and can't get to the bank to pay your credit card statements? The lenders aren't going to care are they.

    It doesn't take a rocket scientist to work out that these charges are unfair and unjustified.

    The only people who should be defending these costs are share holders. :rolleyes:

    I dont have to show you a credit card company that doesnt have these charges. If you dont like the T&C's dont have a credit card. simple.

    I'm no coward and if i were you i'd be careful about throwing words like that around. If I miss a payment due to any other reason other than I had a health issue at the time, I'd take it on the chin. why? BECAUSE I SIGNED THE CONTRACT!!! you cannot escape the fact that you agreed to the CC companies terms. get over it!

    Where would my wages be paid? Since 1985 employees no longer have the right to choose the method by which they get paid. Maybe I should just give up work and go on the dole - although the govt. is now pushing for those payments to be paid directly into the banks.

    Sorry if my believing that banks/credit card companies are not above the law upsets you. I can only assume that if it's not cowardice then you must be either a shareholder of a bank or an employee.

    But Dchurch's point is exactly the opposite of what you are saying and he has the advantage of being right.

    There are Laws about Unfair Terms in Contracts which make the contracts unenforceable.

    Excellent news. I started proceedings against Smile, who are owned by Co-op, and after they acknowledged the claim, they gave the money back plus costs and interest (I did however, work out the interest wrong but it was only a few quid short).

    What if your employer goes bust, or just doesn't pay you on time, or not the right amount, or if for some family emergency you cannot go to work, or something major breaks in your house like central heating for eg and it needs replacing and you simply haven't the money - should you be penalised for any of these things?

    Because that is what these charges are, penalties. Penalties are not legally enforcable in contracts between 2 parties. If the CC company or bank could prove that it costs them upwards of 30 quid to not pay a direct debit or costs them 30 quid to receive a credit card payment a day late then fine, that would not be a penalty - as it stands, no bank or credit card company has proven this.

    Each time I have started legal proceedings against a bank or cc company they have given in and paid up rather than go to court and attempt to prove that these costs really are incurred by them.

    I think that this is simply because, as we all know, that these charges are penalties. I also think a Judge would see it the same way.

    so now we are talking about bank accounts? Frankly, how your employer pays you is between you and them and i would like to stick to the topic at hand.

    I'm going to say this once more then I'm not coming back to it. In this great nation of ours we have the ability to CHOOSE what companies we do business with. If you sign an agreement with a company, should you not be expected to keep to your side of the deal? If you deem the agreement to be unfair you are entitled to end said agreement anytime you wish.

    I firmly believe that no company or person is above the law. I also firmly believe that a person signing an agreement means they should follow the terms set out in it.
