Need some advice on rude landlord

    No thankfully the girl who left is still going to be paying rent (her parents are pretty rich lol)

    I don't think they're going to be doing much about finding us a new tenant, as long as they're still getting their money. That was another thing he said yesterday, he was mega threatening to us in my opinion, telling us that if the girl stops paying he'll hunt us down for the money even if we can't afford it we'll be taken to court and put in prison.

    I'm usually a strong person, and can take a lot of flack and will stand up for myself, but i'm actually scared in case he comes round again because he is so rude and threatening. We're all girls here and I can't believe he just waltzed right into the house.. we could of been naked or anything (not that I make a habit of walking round the communal areas naked, but thats not the point)

    If the agent ever lets himself in un-announced and is threatening I'd tell him to get out or you start screaming rape - as you are all girls with an bloke in your home who isn't carrying ID just 'saying' he is a representive of a LA I'd go for self presevation.

    I would definately take the advise of writing directly to the LL whose name and address should be on the rental agreement. The LA is being unprofessional and they should be made aware of that.

    I've had hassle with every landlord i've had since I moved away from home, why do they all have to be complete !!!! holes? Is there any nice landlords out there? Or are they all money grabbing?

    Do not follow this advice. There is absolutely no need to make false allegations, when your problems with this LL or his representative are real.

    Change the locks - the barrel is very very easy to change. To make it simpler, take a picture of the lock & go to your nearest locksmith. Get the same brand as the fitting will be easiest. If you or your fellow flatmates are unable to change the barrel, call a fellow male student & bribe him with a pint to help you ;)

    Then keep the old lock & keys, to replace it when you leave.

    Write to the LL about the behaviour of his representative, but I wouldn't bother telling him that you've changed the locks. If he later complains, you'll know someone tried to get in unannounced again.

    I didn't say go to the police or report him for it, but as I really doubt the 'representative' is going to leave when asked I personally would play him at his own game. OK maybe rape is too much, try pervert instead.
    As OP said any of them could have been in a state of undress and the last thing you want is this guy turning up at 7am or 11pm saying he is trying to 'catch them out'.

    OP as for every LL being crap I've only had one LL and he was lovely, I really hope you get this sorted and quickly.

    All lock yourselves in your rooms.
    All call the police at the same time saying you are 4 girls in a house and a man has forced his way in.

    Both of these facts are true. in reality you cannot tell who he really is.

    The police, possibly armed, will arrest him and beat the crap out of him in the process.

    He will will never EVER come back.

    I mean, !!!!!! even if he comes in and there is another person living there, there is nothing they can do... the person could be a guest, someones BF or GF... there is no possible reason why they would come around.

    My money is on the LA who came round just being a perv hoping to catch one of you in a state of undress.
    Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.

    sooz last post was good information regarding the locks. You should feel safe in your home, and as a parent I would do this as a matter of course. Again as sooz says, no need to tell the l/l or agent.
    But I would right to the Agent telling him you were very upset at his entry into your home with no authority, and you would advise him that he needed to give at least 24hrs notice.

    Landlord has no absolute right to intrude into your property His only rights to enter during tenancy are:
    a. when Tenant agrees
    b. under s.11(6) of the and Tenant Act 1985 24hrs written notice asking for T for daytime access so L can inspect installations which he is responsible for repairing].
    • In a true emergency (boiler suspected not working is NOT an emergency).
    • If the tenant permits access.
    • If a court orders access.
    · Certainly Landlord cannot just to show property to prospective purchasers or tenants. This is not only trespass (civil wrong) but also harassment (criminal offense)
    Also if you do not have an address for the landlord ask for that also, legally they must give it to you.
    You can force the Agent (A) to disclose L's details. Write to Aa. referring to section 1 of and Tenant Act 1985;
    b. demanding that A provide written statement of L's name and address within 21 days. If A fails to do so without reasonable excuse, A commits a criminal offense and can be prosecuted/fined.

    This address for L CANNOT simply be given as 'c/o A's office'. By s.38, it must be
    a. L's home address;
    b. L's own business address; or
    c. [if L is a company] its registered office address- which might prove to be A's address, I suppose
    I would also put in the letter that the agents representative was very rude and you as young ladies (not drunken students) !!:beer: felt intimidated.
    Therefore in future you require notice in writing of a visit (this means they have to give you longer than 24hrs). Send that off to them and if you have the LL's address send a copy to him.
    Just one thing that you may be interested to know, if you do not want any visits, you are legally entitled to refuse both of them entry. Only do this if it gets really bad.
    GIRLS GET THOSE LOCKS CHANGED good luck :T

    You really spend a lot of time giving poor advice based on nothing more than liking the sound of your own voice.

    OP - go to the student lettings officer for advice. clarify the terms of access in your agreement. contact the landlord expressing your displeasure.

    and what did this guy mean by "well if we don't do that we can't make any money can we?" ?? How does that work?

    oh !!!!!!, the police arn't stupid.

    If he says to the police (while they are beating him) "I'm the Letting Agent" they will ask "do you have permission from the tennant to be in this house" at which point the girls come out crying saying how they just heard the front door open and someone moving around downstairs and how he doesn't have their permission and how he just turned up one day, forced his way in and started looking through their stuff claiming to be from the lettings agent, the police will take 3 seconds to put the cuffs on him and put him in the back of the police car.

    What the so called letting agent (if he even is that) has done is a very serious offense and the police will see it that way.

    I'de be tempted to report it to the police already on the basis that he may not have been who he claims to be and he certainly wasn't there for the reason he claimed. He had no legal right to be there and no sensible reason for being there. He's just a pervert. Contact the police, make a complaint.

    An interesting point is also this: As I understand it, under the new rules (have they gone live yet?) the girls, feeling threatened by someone who has enetered their property without permission or any warning, the girls have a right to defend themselves using reasonable force.

    I'de suggest hairspray or wasp killer spray in face.

    Potentially blinding someone who isn't trying to physically harm you probably doesn't count as reasonable force.

    Whilst the LA might be an !!!, blinding him or getting him arrested and accused of rape isn't justice. Get a grip.

    Send a strongly worded letter to LA/Landlord.

    Change locks.

    If he comes back unannounced and tries to enter the property, phone the police for HARRASMENT.

    P.S. Subletting isn't illegal, might just be against the terms of your contract.
