    We had a similar accident in April of this year. We were stationary in a line of traffic and someone ran into the back of us. We took their details and luckily a photograph of the car and damage. They told us they would get back with details of their insurance company but they never did. We passed the details on to our Insurance and they dealt with everything and we got a curtesy car whilst ours was being fixed. The other woman didn't actually admit liability for the accident until the end of August:eek: when our insurance threatened to take them to court.

    I haven't got the money to pay for the repairs, and the third party won't pay for all the repairs. I've got no choice but to go through the insurance company, but they appear to be doing nothing to sort it out.

  • And as for the b' insurance companies "doing alright out of it", they are having to pay for the repairs you know!!! :rolleyes:

  • To all those people saying "whats wrong with her paying for it" - what if the OP gets it done and then the other person refuses to pay for it?

    Phone your insurance people everyday - try and get the name of one person and try to deal with them every time. They'll get fed up of you soon enough - mention the Ombudsman if nothing is getting done either.
    Never argue with an idiot. He will bring you down to his level and beat you with experience.

    I had legal assistance cover with my previous insurers and they passed an accident to a loss recovery company who were worse than useless. There was no problem getting the repairs done although they were slow to process it their end and it showed up as a fault accident in my renewal. I was not best pleased and had to fax them the letter from the loss recovery firm which had enclosed the cheque to refund my excess from the other driver' insurers.

    I would say though that Diamond were very good when one of their drivers ran into me. The telephoned the same day to admit liability and after some bartering about the value of the car I received my settlement money in less than two weeks.

    Not sure about their response to my injury claim though. I am trying to work out whether it is my solicitor or Diamond dragging their heels. I suspect that Diamond are being slow and my solicitor is not putting any pressure on them. I am using one through my legal expenses cover but having double checked my policy, I am covered to instruct my own so I think I will be doing just that.

    You have comprehensive insurance, which gaurantees your car will be repaired by your company. The only thing which delays matters is if you don't use their "approved" repairers because you insist it is repaired at a dealers. I assume this is not the case for you. If what you say is true, it has nothing to do with the person who hit your car, stop harrasing them and start harrasing your insurer.

    I made it quite clear how to go about dealing direct with the 3rd party, and repairing the car first was not an option I listed.

    I thought the other party was legally obliged to give me their insurance details after an accident? All I want is their details so I can give them to my insurance company.

    My insurance company cannot proceed any further till they get these details from me. They will not authorise the repairs at the garage until they have the third party insurance details.

    At the moment I'm stuck driving a damaged car, because nothing can proceed till the other party give their details. It's been 8 days since the accident. Surely that is more than enough time for someone to give their details?

    Your insurer is lying to you. Write them a letter stating you want your car repaired NOW, and if they do not authorise the repair within 7 days you will write to the financial ombudsman.

    I agree with this. They do not need the third party details to authorise repairs. If the OP had caused the accident she could still claim her own repairs on her insurance so they are not being truthful.

    All you need to do is pass their details onto your insurance company, phone number etc, car reg etc. your insurance company tell you which repairers in your area are authorised, you book the car in and it gets fixed while your insurance company chases up the other persons insurance details.
    They can find the details out no problem.
