incapacity benefit help!!!

can anyone help with incapacity benefit as i was on income support for 2 years and have 3 children all under 16 yrs old i have just declared my partner moving in, and reclaimed they said i can't claim income support due to my partner working 25 hrs a week.
My partner is self employed and is caring for me I've also just put In a claim for DLA and cant claim carers allowance yet!
MY partners hrs are different every week not always 25 hrs so what can we do, like this week my partner is only working 4 hrs and he has to take and fetch the kids from school as i cant due to health reasons...
Also has to fetch the during the day if one of them gets ill i can't see how we can get IB if his hrs are different every week....
Any ideas???

Surely he knows his average hours a week? This can be taken from invoices or a his pay packet? Say the last 12 weeks?
You can declare his average based on these, but keep the evidence in case you are challenged. If the hours change by say 10% notify them again.Also has to fetch the during the day if one of them gets ill i can't see how we can get IB if his hrs are different every week....
Every parent in the world has to do this, theres no reason why he cant work and do this.

You won't be eligible for IB if you don't haven't been paying National Insurance - it's not means tested. If you get a high level of DLA, then your partner may be able to claim Carer's Allowance, it's not something that you claim for yourself.

Well he used to come around every day to take them and fetch them, i can't go shopping either so he has to go for me, i can't leave the house i'm housebound and recieving medication....
Every other parent can take and fetch there children and go to work but not every other parent has to leave work during the time they are at work to fetch there children this is why hee can't work normal hrs...Garden Designing available for the fraction of the costs!:D0 -
How often are the children ill at school and needing to be collected? It happened about 3 times in my children's school lives and there were 4 of them. Broken arm was one time, can't remember the others.0

But you never know when somethings going to happen, if i had my choice my children wouldn't be at school i would have them at home that's because of my illness that makes my life hell, i have to send my children to school!
I hate them being at school i have a fear of life or shall i say the world i dont want this to rub of on them!

People are not 'having a dig', but what you are describing is what most parents have to do, it's not unique and not even unusual.
I recall having to leave work and drive 25 miles because daughter had slipped on an open-tread wooden staircase at school and was suspected of having a broken arm. Things do happen but you just live with them.
Why do you want to limit your children's possibilities in life by not sending them to school? Education is one of the most precious gifts anyone can give their child. What on earth is a child expected to do at home all day, unless you have the skills, knowledge and abilities to 'home school'?
As to collecting shopping, you can obviously get online, how about online shopping and getting it delivered?
I was more or less brought up by a woman who could rarely leave the house, my aunt, a polio survivor who moved on hands and knees. She wouldn't have dreamed of not sending me to school and yes, she did get shopping delivered![FONT=Times New Roman, serif]Æ[/FONT]r ic wisdom funde, [FONT=Times New Roman, serif]æ[/FONT]r wear[FONT=Times New Roman, serif]ð[/FONT] ic eald.

As already suggested you can get an average of hours eg. the last three months (I'm not sure exactly how many they require). It might be an idea to phone Citizens Advice or ask someone who is helping you with your health about benefits to make sure you get everything you are entitled to.

I don't think that anybody's having a dig. People are just suggesting that nobody can run their life around preparing for a very rare occurrence. I don't think anybody could operate on the basis of not being able to work normal hours just in case a child might be taken ill at school! People go to work and then cope in the case of a rare crisis.0 -
