Anyway i had the phone call this morning after i wrote on here from the job center the lady was helpful i went through the process of claiming IB and change the Tax credit, the lady told me to ring my local job center as my partner maybe able to claim JSA as well as work a number of hrs a week...
But we wouldn't be able to claim IB obviously...I also have to ring the tax credit when i hear about the IB

Have you previously been working. I thought I read you were on IS. In which case you cannot claim IB as you have not paid your National Ins contributions.
I think the best avenue to go down maybe Tax Credits. If you go back onto Entitledto, enter your partners income annual figure as £70 x 52 wks or 50 if he takes holidays etc. Total £3640 if he worked every week of the year. I think as long as he is working more than 16hrs you will qualify and I think you get extra if its more than 30hrs.
You will definately not beable to claim Income Support whilst he is working and living with you. But I think you'll be surprised how much tax credits you would be entitled to and I'm sure you would qualify for other help eg Council Tax benefit and maybe help with rent if you are renting that is.

If you partner claims JSA he will have to be actively seeking work for the days he claims for. He won't be able to say he can't work because he might need to pick a sick child up from school! He'll have to prove he's jobhunting and will have to accept a suitable job if it's offered.

Yep thats right but he would have to leave work staright away if one day one or both of my children where ill!!!
Not saying they will be!!

It is a better use of his time if he were working full-time and a taxi were to bring an ill child home.
After all, it's not as if there's nobody at home. You are there.
Send him out to work and have an envelope on the window sill that's the taxi fund to pay for one that turns up bearing an ill child.

Can you imagine how long it would be there for!! (All of 2 seconds where i live) the school is only a 2 min walk so there is no point...
