  • Cashback isn't about clarity. Whilst that clause is definitely not a get out free card I would never hope to rely on that in this case. Since you aren't convinced, I would add that each claim form also comes complete with the mobile number you took out through them. If the bill has a different one, goodbye claim - and all future claims. I would say that I have found this company excellent (the complete opposite of cpw now, unfortunately!), but without written confirmation I would never do it!
  • Cashback isn't about clarity...

    I'm not new to cashback deals - I'm currently in my 4th year now with 2 phones, so that's 8 deals in total. I say this not to 'brag' (what's to brag about?) but to show that the point I was making was one of clarity for this particular deal, with this particular company.

    I've never gone beyond the CPW group for my deals and, despite the fact I have heard complaints about them, they have never given me much trouble.

    On one occasion they failed to pay me in the specified time, claiming that their new terms stated the auto cashback was after 6 months, instead of 1.

    I took them to court, they didn't defend and paid up in full - the entire cashback value, not just the one payment. This is because they had breached the contract. There really was no defence possible, and there wouldn't (in my opinion) be here either.

    The reason why I was wanting 'clarity' on the issue you raised was for the same kind of reason - if there isn't anything which states they will refuse cashback if you change number, then non-payment will be a breach of contract. It really isn't good enough to suggest your claim will have no merit because the claim form number doesn't match x, y or z. The law is very clear in this respect.

    Anyway, I doubt this is of much use to those who were thinking of changing numbers, since most people would back away from such action if they were faced with a refusal - this is, I'm sure, the intention of the company involved and no doubt why you would want to warn us.

  • I'm afraid I disagree. Porting is allowed as specified on the website. If we're comparing the number of cashback contracts then I currently operate 10 of my own and look after nearly as many for others. In total I've had or watched over at least two to three dozen in the last two and a half years. I accept that I don't port - but advising people to do what you are suggesting merely because it doesn't say you can't is not something I would ever do. If others wish to and are prepared to sue if needbe, they can make their own judgements on the likely outcome of their case. Whilst cpw never goes to court (usually with good reason) they have evolved dramatically from what they were to what they are. They are not the only organisation I watch closely who have done that and so I would always advise people (should they wish to embark on any cashback deal) to follow the legal t&c and not take risks with things which aren't specified. What a particular judge may or may not decide in this respect is much less predictable than the situation when you had to sue. I would bow to Quentin's expertise in this matter, but that would be my view.

    I've not actually advised anyone to do this - I merely stated that there is no legal position to deny cashback. I did, however, state that it would be unlikely that most people would enter into such a deal on that basis.

    We can either follow the T&Cs, or not, but not both. It really makes no sense to suggest that something which doesn't exist could prevent a claim.

  • Does any one have any experience on their cashback deal? Do they pay promptly? I an looking for a cash back deal and am new to phone 4 u. In the past i have allways dealt with CPW and they have generally been good.
  • The good deals I mentioned yesterday are now gone. There are still 11 month free deals on M2YD, however.

    With regards to your question, the general consensus seems to be that they are relatively good at the moment. Don't forget that things can change in an instant. In my opinion, the greatest risk to the success of your cashback claim is the risk of Phones4U becoming bankrupt. How likely that is is a judgement you will need to make
