I feel we are not on the same wavelength....the replies I have posted are specific to Kayak case...and given the medical condition she has described then she MUST advise of her worst day senario .....and to reiterate previous information ...a welfare rights officer or social worker will advise her of this....to allow an accurrate assessment of her needs and award component. I am aware there are many people who are in receipt of this benefit and it could be questioned as to whether thye should recieve it or not.. which can be frustrating ....

healy this is just to say a big thanks for taking the trouble of replying indeed i didn`t expect any one would bother with my rant but there you are ther are a lot of people willing to give good advice. some days i am just unable to cope with just surviving, and it doesn`t come easy to me as i have worked hard all my life despite the pain i have and do suffer. this is nobodys fault and o course i am better off than a lot of poor souls. i hear of so many "scroungers" and know them lol too but when people are genuine they should be at least listened to or asked to be seen by an appointed doctor and evidence shown to uphold their claims. surely this is not being unreasonable? anyway i will keep people informed as to how i get on thanks again i will take your advice i may be making the mistake of not wanting to "bother" people even my gp who is new to me thanks againNo you are wrong, she MUST detail her good and bad days not just her worst day. this is to thank you jazza for pointing me in the right direction as i said to healy there are a lot of very kind people out there i appreciate the replies posted andwill keep people informed as to how i get on i phoned the DLA office and they advised that even if my case is re-assed and still refused i can then ask for an appeal about the decision. good luck to people trying to get any entitlements they are due. more power to all of us thanks, kayak3kayak........... Go to your local Social Work dept and ask for a financial assessment to be completed for you and your husband.....they will support your DLA form and consider carers allowance for you husband......Good Luck....0 -
It would be wrong to detail only the worst days.

I wouldn't know what my good days are, I suffer terribly 3 weeks out of a month, the only one week left out of a month, i have better days but not good days, that one week, i am so drained and tired from having constant hormonal migraines which i've had for 2 weeks now, one more week to go before i am a bit free of the migraines, even then it leave me with a very dull ache in my head, my concentrations are very poor.
Saying this I do agree with you with the good days and bad days, because that would put into consideration what rates dla rates would be granted or if anyone would need it at all. As for me i am not counting my chickens, i've been without dla for four years now since my health got worse, i can do so again, it was the Job Centre that suggested dla to me. Would you believe i read from some forum, someone get dla for gardening in the summer and that same person apparently always go to theme parks and go on all the rides and go out to do all the activities going, she is 23 years old with no children, she gets higher rates Mod/Care so it just show you, write the correct jargon and bingo the world is your oyster. I and my 14 yrs old son are trapped indoors because of my disability, poor child hasn't had a holiday for years and can't go anywhere because of me. i've asked dla for a lie detector test but they've refused me, when i asked why they say they wouldn't go that far, so why refuse me then.
Anyway i am into seeking help from a Welfare Rights Officer.

For a fee of £18.95 you can get access to an enormous number of documents giving advice on all sorts of benefits and how to claim successfully. I applied for DLA and was rejected. I then found this web site and read their DLA documents very carefully, re-applied and was put on Higher Rate Mobility Component without a medical or interview (I have fairly severe spinal, ankle and knee problems).
I have no connection with this web site other than being a paid up member of the organisation. A lot of material they use has been generated by Freedom of Information requests to the relevant Government body. It us run by advice worker turned barrister Holiday Whitehead and benefits writer and trainer Steve Donnison. I highly recommend them and my shiny new car out the front and my Blue Badge testify to the effectiveness of their advice.0 -
Hi All Just thought I`d give you a quick update from last post on 23rd Sept 08 I had outlined my health problems to you and had advice from Jazza and healy whom I thanked. The report from my GP was decidedly unhelpful as the form he filled in from the DLA said only mild this and that. I have since spoken to him and he is willing to give me a letter of support.I know he has recently discussed me with another GP in the practice, as he is fairly new. The funny thing is , ireceived a letter saying my claim was disallowed then a phone call few days later by a local GP saying he is visiting me this Tuesday??? I wonder what is going on has anyone else found themselves in this position? I will of course post another message with the outcome!! I wait with interest gl to all still fighting their claims0

It looks to me that they have decided to take another look at your claim and have decided to send out a Doctor in order to get a report to decide if you qualify.0

hi there I said I would update you if anything transpired after the doctors visit. I had already been told by phone and letter I was not eligible to claim DLA at all, then of course they sent the doctor to examine me at home. He spent well over an hour testing what I could and could not do for myself. i was on my own as my husband was at work. He asked about a typical day, then asked me to lie on top of my bed to see how I managed n and out of bed. He asked me to lift my arms up move my hands in certain ways etc. It was a very thorough examination I felt. I could not tell whether he saw my case as being eligible or not as he was mostly expressionless. Then two weeks later I received a letter from DLA saying they were awarding me the lowest rate for both mobility and care, about which I am delighted. I really thought it would take a lot more wrangling with them but it goes to show it can go in your favour too. I know a lot of people are turned down time and time again, so I can only thank my lucky stars that I got this on my first attempt. Many thanks to Jazza and Heally for there input and hope this encourages others to apply for DLA if your circumstances are such that you need help.0
