DLA been refused please help me

  • hi all as a new member i have been reading all i could find about claiming DLA I am 63 years of age have worked full time since 15yrs old. started having back problems after first son was born whe I was 19 have visited numerous orthopaedic doctors had cortisone injections, put in a full body plaster at 32 yrs old for one full year .exhausted every treatment ,chiropractor, osteopath etc now at 63 have had to give up work both ,hips have bursitis (more cortisone injections) can barely walk sleep eat because of pain now its arthritis in all joints have been told by ortho surgeon last month problems ongoing for too many yrs etc also pelvis tilt and scoliosis of spine I also have heart problems unstable angina, mitral heart valve not functioning ,heart arrythmia left heart bundle branch block (hearts electrical system) enlarged left side of heart c.o.p.d. asthma bladder incontinence and other minor problems resulting in a very difficult time trying just to survive thankfully I have a very good husband to care for me I filled in my DLA form myself being as straight about my illnesses and how they affected me guess what they fefused my claim and didnt notify me when I phoned after 2 mths hearing nothing was asked did I WISH TO BE RECONSIDERED?not knowing any better I said yes but maybe thats not the route I

    No... it's not the forms are based on the worst possible day someone can experince and any good welfare rights officer or social worker will advise you of this ...so it's not about cheating a system it's about letting the panel know what can be experinced and how the illness incapacitates someone.......so anyone applying don't feel bad about explaining your worst possible day......

    kayak........... Go to your local Social Work dept and ask for a financial assessment to be completed for you and your husband.....they will support your DLA form and consider carers allowance for you husband......Good Luck....

    .......on another note......ask at S.W. dept for an application to Chest, Heart and Stroke Charity which will allow you to apply for up to £300 to allow you to have a short break away with your husband...if your able.....take care

    No you are wrong it is not correct to detail only the worst possible day. If a welfare rights adviser advised this they giving incorrect, possibly fraudualent advice and you would be cheating the system especially if people have more good days than bad. If people take the quoted advice they could be in serious trouble.

    It is correct to detail good and bad days or typical days.
  • If people are having more good days than bad then there is the question as to whether they would qualify for the benefit... or even apply......and i am not giving false information because the information regarding a bad day MUST be recorded because an illness impacts on the persons life and effects both physcial and emotional development and therefore prevents them from acheiving all they aspire to do in there life....

    That is the point I am making if people have more good days it would be wrong to ONLY quote their worst day. As I said good and bad days must be detailed not JUST bad days that is where it would be wrong.
  • I feel we are not on the same wavelength....the replies I have posted are specific to Kayak case...and given the medical condition she has described then she MUST advise of her worst day senario .....and to reiterate previous information ...a welfare rights officer or social worker will advise her of this....to allow an accurrate assessment of her needs and award component. I am aware there are many people who are in receipt of this benefit and it could be questioned as to whether thye should recieve it or not.. which can be frustrating ....

    i thought only people under 60 could claim DLA and over 60 have to claim attendance allowance?
