  • hi all thanks for putting your points ,my son has read them and laughted when someone said he was gay[ hes not and has a girlfriend] he is moving in with a mate , the mother has moved out and left the housing benefit in place ect shes doing that for a month ,then she gonna tell ha that she wants the house put in her sons name ,my son is moving in on saturday i have dicided not to say anything till nxt friday to our housing officer just in case things dont turn out

    This just sounds more dodgy.
    Seriously your son will be left in the cack and potentially involved in a benefit fraud case. If he is working then he needs to declare to the council he is living there. This will affect the benefits.
    If he isn't on the tenancy then he can be left homeless instantly.

    Ok - when you say "left the housing benefit in place" you mean committing fraud.

    When you say "she gonna tell HA she wants the house put in her sons name" - you have not read what other posters have said - there is no chance of this happening. The HA has a responsibility to make the best use of their housing - this will not include giving a three bed house to an unemployed single teenager/young adult. If she chooses not to tell the HA this is again fraud.

    When you say "i have decided not to say anything until next Friday to our housing officer just in case things don't turn out" - do you realise that you may be putting your own tenancy at risk (assuming you are in temporary accommodation that has been provided to the family unit through homelessness legislation).

    You have been offered some good advice here, from people with knowledge and experience, but you have decided you know better.

    I suspect you will be posting again once this new arrangement fails. If this happens please don’t just ignore people who are trying to help.
  • hi again son has now moved out i have told our housing officer that hes left [ it doent really bother us as he had all ready made his own homeless appacation] if things do go wrong where he is he will still be able to move back in here ]i dont know whats happening with his mates mums benifit or tenancy just made son and mates a load of food to go in freezer so at least they dont starve

    Oh well. You can just look on and keep your fingers crossed now.

    As long as he's aware he will have to pay the council tax and it will affect his friends benefits by him moving in there is nothing else you can do.

    Back in the 1960s the Rent Man would come round and collect rent.
    If they did that now I bet they'd see all sorts of odd things going on that were different to what they believed was going on in houses.
    Things like people who've sublet without telling the council/HA, undeclared HMOs... all sorts

    Dont be surprised that he was housed with his family, if he was part of the family unit when they made the application for homeless assistance the authority had to include him irrespective of his age, hte accommodation must be suitable for the applicant and everybody who can reasonably be expected to reside with them.

    Goodness, I hope these guys know what they have let themselves in for!

    A bit of background: Myself and my Husband lived with my parents in their 3 bed house rented from a Housing Association (I lived here from 2003 when they moved in and my Husband from 2006). My parents needed to move as my grandparents needed permanent care and a carer visiting 3 times a day, which my mother would be carer, and it just couldnt be done from about 40 miles away. They spoke to the HA to see if we could stay on in this house and it got very complicated. Since we had such extreme circumstances we were eventually lucky enough to eventually be allowed to stay on and take over the tenancy.

    Now as I say, under our circumstances it was allowed and arranged BEFORE my parents moved out. I cannot see any housing association giving up a 3 bed house to her son even though she has now moved out. This should all have been sorted before she moved, and I also cannot see them giving the tenancy to the son just because his mother wanted to take up and play house with her fella!
    We were told they dont normally do this kind of thing, but under the circumstances they couldnt leave us homeless because of the reasons my parents had to leave. Also, could it be possible that the mother had the tenancy signed over to her from someone else? If so, I was told they cannot reassign a second time!

    Im quite worried your son and his friend will have to find somewhere else to live since no one seems to care about the HA's involvement in the tenancy issues. They will choose if the tenancy can be handed over to her son, she does not make this choice! It was quite a stupid move on the mothers behalf to think that this could even be considered acceptable. I just hope they have time to find somewhere else when the HA show them the door!

    Edit: Im also sure that a person has to be on the tenancy agreement (with the other person) for a certain period of time before they can take over the house.
