    I agree with Sooler wait for a response from Head office. I'm a little surprised that they are so pedantic about it, checking through the CCTV must have cost them more than the issue is worth and if you do have to go through the small claims route that will cost them even more if they choose to defend.

    There is another issue here. The Data Protection Act requires there to be a purpose for using CCTV and that purpose, clearly, is generally security. It is stretching the permitted purpose quite a lot for recordings to be made to check up on the date customers return things to the store.
  • Like some others here, the CCTV recording sounds to me like it might be a bluff.

    Sooler's observation that the 6th was a Saturday, the 8th a Monday, is a good one. Germ73, which day are you more likely to have visited Staples? Most people would have been at work on a Monday. You'd feel more confident about your stance if you could be 100% sure which day you went in, right?

    But yes, let's see what response you get from Head Office first. If they were bluffing about the CCTV, it's likely they'll back down immediately.

    I cant remember what i did 5 minutes ago, let alone 10 days ago!!

    So my best course of action now is to write to HO again requesting that printer to be repaired/replaced under SOGA???
    Is ther any particular paragraph/statement i should use?

    Have to disagree. Preventing loss to a company is part of their remit.

    As already stated you can contact the Information Commissioner to will explain that for the fee of £10 you can request a copy of the cctv footage. Interesting to see what happens? Do you fancy spending a tenner?
    The usual way round this is for the company to ignore the letter for a period of time,then write back saying that they have recorded over the footage. Now if they did this with you,they have lost their proof.

    It would also cost the company several hundred pounds to get the disc professionally touched up,in order to edit out the faces of anyone else on the disc-although you won't be able to view it without professional equipment- (they don't know you haven't got access to this)it would be interesting to see how they handle this request. Can't see they are going to pay out all that money rather than come to an agreement with you.

    I recently took an item back to them,which was faulty,for my son,and I have to say they were very devious and economical with the truth about what I could expect from them. They really didn't want to part with their money. I say this a lot,but have you tried asking for gift vouchers,if you are not up for a fight-they are often prepared to give these,as it shows as a "sale" on their figures,rather than a minus?

    I was under the impression from your first post that you had already done that and mentioned that you were willing to take court action. I would assume that you gave them a reasonable time to respond i.e. 14 days. I also assume that you kept a copy and sent it recorded or got proof of posting.

    If the time has now passed with no response further letters hardly seem worth while. You have now two choices, issue a claim via the court or, and the one I would suggest in your case a trip to CAB before court action, Surprising what a phone call from them manage to achieve plus it also shows that you have tried all ways to resolve this before issuing proceedings.

    They can easily provide a printed image on paper.

    Are Staples saying the 9th or 8th?

    Initially you said "Staples have since told me that the printer is no longer under warranty because they have cctv footage of me returning printer on 8/9/08( ie one day outside warranty)

    so the 9th (Tuesday) would be 2 days outside warranty :confused:
