Parking ticket in Asda car park - Is this legal, can they take me to court?

  • Having a disabled child, I get furious when old people give me dirty looks (and on ocassions abuse) for parking in the disabled bay because they feel they are more entitled because they are elderly. We tend to prefer to park in parent and child spaces because we have other children too. I have noticed that the elderly disabled drivers love parking in the parent and child spaces when there are no disabled spaces available as they think they have the god given write to park anywhere! After observing some elderly disabled badge holders (whilst hubby went into Tesco) I noticed some of them can walk better than me!!!

    Just after an opinion from any blue badge holders on this one....

    If a supermarket car park is totally full and there are 10 empty disabled bays are abled bodied people allowed to use them then? I'm all for helping anyone who needs it and as a youngster I don't need or want to park next to the door but i must say i would use a parent and child/ disabled bay if there were no others left....

    No, you shouldn't use them - and under the DDA, it will soon be illegal for stores etc., not to enforce these bays, which will mean fines and clamping for those who abuse the bays.:T :T

    Not everyone uses a wheelchair - my OH doesn't, but he cannot walk more than about 10 yards without any pain due to breathing problems.

    Why should he have to struggle like this because people are too stupid and lazy to park with consideration?

    We can borrow a scooter instore for use instore (you can't use them in the car park), but we have to get from car to store.

    We are finding that unless we get to the store really early, we cannot park, and the majority parked are not BB holders..........:mad:

    Still, I'm tired of arguing with these ignorant sods - we park behind them (providing we are not blocking through traffic), and then THEY have to ask for it to be announced over the intercom for us to move the car, so they can get out.;)

    And, of course, they just have to wait until I have finished shopping. ;)

    You probably should not use a disabled bay but as far as I am concerned the Parent/Child spaces are free for alls if the car park is busy .. I have used them on a few occasions .. if anybody complains I just tell them my mother is still shopping.

    It's hard to get anywhere near my local Asda as there are so many disabled/parent & child spaces allocated. I have and will continue to use parent/child spaces if I can't get close enough. I am happy to avoid disabled spaces but would never pay a fine if I had used one.

    In any case, TCP (or any other Private Parking Company) cannot "fine" anybody for parking in a disabled space or for parking on privately owned land for over 2 hours. Ignore any ticket and they send an invoice to the Registered Keeper inviting payment. Of course, any invoice (under contract law) is only applicable to the Driver - not the Registered Keeper.

    Just ignore any letters/threats and shop elsewhere in future.

    It is also worth carrying a battery operated grinder which removes wheel clamps before you can say "look out here comes a Private Parking Company con man pretending to be a Traffic Warden".

    Well lets just hope you never end up disabled, because you may then be forced to change your ignorant view.

    As for parent and child spaces, they exist for two reasons:
    1. To allow the extra space required to get children in and out of the car, so that they don't cause damage to the next car, and to allow room for a pram or pushchair.
    2. So that the distance is as short as possible that small children have to be taken from the car to the supermarket. Car parks are a very dangerous place for toddlers who can't see over cars. Before you say that the parent should keep hold of the children, any parent will know that children have a habbit of slipping out of a parents grip.

    The Equality and Human Rights Commission said Labour MSP Jackie Baillie's bill in the Scottish Parliament was a straightforward, practical and cost effective means of making a real difference to the lives of disabled people across Scotland.

    Ms Baillie wants to make all disabled parking bays – including those in supermarket car parks – legally enforceable with fines of up to £60 for drivers who breach the ban. At the moment most disabled bays are only "courtesy" spaces and other drivers can park in them without fear of a penalty.

    I hope this comes into force across the rest of the UK. I am disabled and I find shopping quite difficult, this is made worse by some ignorant person parking thoughtlessly.
    I do not care for those who rant on about not paying fines. You parked there. You knew it was wrong. How would you feel if it was you or one of your loved ones who couldn't visit the shop because someone had parked inconsiderately?

    Thanks for reading my mind and labelling my view as ignorant.

    I said I would avoid a disabled parking space. My Mother is disabled. Parentt/Child spaces are very nice gesture and I would not park in one unless necessary.

    The point of the post is very clear - these "fines" are not fines. They are invoices which have no place in law. The "fine" is an invoice for breaking a contract (which is usually a sign placed in a car park). These private parking companies are low-lifers who scam money from ordinary people by extorting money for parking a few minutes over the allotted time or parking in a restricted bay. They are NOT interested in preserving disabled etc spaces - just extracting money.

    DO NOT PAY ANY "FINES" from these private parking companies. They are con men and you are not obliged to pay their invoice.

    I am not advocating parking in any restricted bays, but theses PPC's have no right in law to demand payment from the Registered Keeper. They are a world apart from real Parking Fines issued by Police/Local Authorities.

    BTW please notice I have not traded insults here but am quite willing to do so if you wish :rolleyes: and I'm very good at it :p

    This isn't the same thing as saying (as you did in your earlier post "I have and will continue to use parent/child places if I can't get close enough". If there is no other parking spot in the entire car-park, many people would agree with you - use the p/c place.

    However, it's rare in my experience, for there not to be other spaces, they're just further away and it seems that there are people who panic at the thought of having to walk a few hundred yards to get to the shop door!

    It is strange that this very old thread has been revived and by a newbie too!

    Was it done to get you noticed parkerparker or do you just like a good old squabble?
