Ha that made me chuckle - they won't be looking into it at all - any more than someone will be looking at your account when you go 5p over your limit.
If it's one thing I have truly learned over the last 12 months - it is that banks will lie, wriggle and do some very disgusting things to look after a few quid.
I would imagine that you will probably get another automated letter in about 4 weeks, saying "we have investigated your concern and have come to the conclusion that the charges were applied in accordance with the t&c's etc....blah....more lies....blah...."
I hope I'm, wrong - but sadly, that's how banks act these days.0 -

Just like a bank! Don't actually listen to what the customer has asked for, just treat them like the next number in the queue (and yet they claim to look at breaches of contract personally, hence the high charges!!??).
You're getting the swing of it - it's all part of the game - they hope that you will now think you are hitting a brick wall and just go away.
Don't - what would they do if you had taken money from them illegally (or even just had a doubt that you had taken it illegally?)

Ok, what are they saying here?
That the acts quoted (Dunlop, Leisureplay et al...) are irrelevant to this issue? (e.g: they relate to a punitive charge, but what we do is provide a service, so doesn't count, neh-neh-neh)
That punitives are not recoverable? (well, in punitive damages awarded by a judge, maybe, but that's a different story altogether)
If the latter, can we conclude that the fathead is actually admitting they ARE punitives?
I don't know, I'm getting more and more confused...

Well, he can say it... Doesn't mean you have to listen, does it? :rotfl:
Don't bother wasting any more time, don't listen to him about the Ombudsman (as he knows you won't get anywhere that way), just go ahead with the legal action, and see who wins on that one :T

I have incurred "penalties" charged by Yorkshire Bank over a long period of time.
It is difficult for me to calculate how much to sue my bank for.
1) How far can I go back with my claim?
2) Will the bank provide me with details of charges going back e.g. 5 years?
3) Do I just submit inflated claim for say £5,000 & let bank provide evidence to court of actual value?
Also, the bank closed my account due to increasing overdraft as a result of such charges & I am still paying them back.
I am determined to get something back & will let you know how I get on.0 -

Mine is a Barclaycard and they asy "Thank you for taking the time to contact us regarding the level of service received from Barclaycard.....we aim to resolve matters by the 14 March 2006" They also enclosed a leaflet about how they deal with complaints.0 -

i already have the charges from previous statements so i dont need the copies they are sending.
what do i do now press ahead with legal action, send another letter?

I've just tried to get on the BAG site, but can't, they must be having technical problems. I would press ahead with the letter threatening legal action, I'm doing this with Nationwide, they jst ignored my 'nice' letter.Total debt May 2005 £83,232 :eek:

Yes I know I'm easily confused so can I ask- is it worth starting the process with HSBC and Natwest/ Marbles credit cards ? Or is it worth waiting until the current legal action plays out? Am I likely to still get a result or have I left it too late ? (only just become aware of all this
)
