    Hi,
    Just got a letter back from the bank that gives you extra.

    Basically saying, you have agreed to the terms & conditions for the charges.

    The acts quoted in my letter are applied on a punitive bsais, they could be considered irrecoverable.

    The cases quoted do not relate to any financial organisation & futher no legal rulings have been made in this respect to the validity of these charges.All charges are ratified by our legal dept & are representative of actual costs incurred and applied on that basis.

    I have ordered a account report to highlight the charges you have incurred.
    If I do not hear from you within 8 weeks I will assume you are satisfied with our responce to your letter.

    So is my next step............wait for the report of the charges, then write to them again asking to be refunded within 7 days, If that fails take them to court.

  • They didnt want to know us either but paid up before court.
    Why is everyone on here so nice/tollerant with them when they are so uncoperative and hard faced with customers ?

    Sorry, I'm confused. Are THEY saying the above in their letter to you? They're admitting these are punitives? That would be REALLY useful if they had!!!

    Me too - the sentence appears to be an oxymoron - they are PUNITIVE 'and' IRRECOVERABLE ????

    This could be a fantasic coup if the letter really does say that.

    Just got a letter from barclays customer services (only sent the letter last thursday) -

    'We are sorry etc etc
    we are looking into your concerns and will let you have an answer by 16th march 06 etc'

    is this a standard letter or are they actuall looking into it?

    Has anyone had any success with barclays yet?

    Got my second reply back from Mr just who has agreed to send me a copy of all statements?? - I just wanted a breakdown of charges not statements, but ah well. Will get them within 3 weeks and didnt charge a fee, says he has sent my cheque back to me, but it isnt there!

    He says lastly this is the bank's 'final response' on the matter and that any further complains should be taken up with the ombudsman. Can they actually say this is their final response though? In 2 letters he has not acknowledged the legal action at all so will get a nice surprise when it lands on his desk once i get the list of charges.

    Are Lloyds a tough nut to crack or is it part of the game?
