Bank Charges - illegal?

Thanks to everyone for posting on this board. I'm new here but have read all the posts and have found it informative and very useful.
I'm in the process of taking Lloydstsb to court for around 2K for bounced direct debit and overdraft excess fee's. I had previously sent them a letter stating my case and asking for the refund, In which i got the standard reply. I then telephoned and had a very snooty and patronising conversation with one of their managers, In short refusing to refund the money. I'm now taking them to the small claims court.
The reason for the charges: My company was struggling to stay afloat, so my personal account plus the business account and two i switched to all were heaped with charges. This may be bad management on my part but even so the 2K from lloyds, plus business charges, HSBC charges and Barclays would mean that i maybe wouldn't have been on the brink of bankruptcy or doing something stupid. To say the least i am fuming that i have had to struggle so hard over the last two years to pay back money when these banks have illegally been robbing me blind. No wonder so many people in this country decide to declare bankrupt.
Rant over for now, once again thanks for all your advise.

Does anyone know how they give you your money back is it credited to your account or do they send you a cheque??
lloyds to seem bad yet the one we have the most evidence against
they usually credit it to your account (if you still have one ) but they may pay you in any legal way they want.Wish I could stop editing EVERY post I make :mad:0 -

I opened an ccount with A+L in feb so that I could save via regular saver and online saver 2. I transferred some cash from A+L current to online saver but in the meantime they also transferred a regular payment to reg saver so I was overdrawn by 1 day (the money was still with A+L now in online saver)
I was charged £25 and duly refunded. 2 weeks later they charged me another £25 saying that it was a follow on charge.
They will not refund me so I have written a letter to close my accounts and to claim the £25. I am tenacious and will no way let this drop. I have quoted the 1977 act
They are one scumbag of a bank. I am astute and moneywise and they caught me out so pity help anyone who can`t understand the statements etc
I am moving £4000 to my smile/coop account which I have had for 35 years without a single charge
As soon as the 12 months is up for my DH we will also move his 3 accounts out
PS it is quite difficult to close the accounts, they did say they would ring back hours ago so signed-for letter is being posted tomorrow0 -

I have sent a court summons to BOS claiming back the charges for "being overdrawn and we've had to reject a dd and if your still over 30 quid in the red" etc.
Maentime they continue to add charges and send letters as we are no longer using the account. Can I add these charges to the claim I have just lodged or do I need to treat them as a separate issue?
I am going to have the account closed. Already set up with another bank.

Assuming that offer to settle, you can point this out to them at the time and ask them to include the charges in the claim. If they refuse to do so, you can't insist if they offer to pay you 100% of your claim. If they do that simply sweep up the charges in a second claim.0

A bank can cancel an overdraft at any time for any reason and demand the money back. Your accounts terms and conditions will state whether the money has to be paid back immediately on demand or within 30 days etc (depending on account etc) - i.e. you have already agreed this time limit.
