    Thanks bookworm, I thought that would be the case - but I have limited faith in these institutions!
    I will start the ball rolling tommorrow with a letter asking how much the charges amount too (ouch!)
  • I filed litigation against LloydsTsb last night to recover £2963.68 worth of charges including 8% interest and £120 court costs. Would of done it a little sooner but had to save the court fees up. All thanks the BAG and Dchruch 24 on here

    Hi - is anyone able to help on my post? Worried about claiming back charges because the bank could decide to call in my overdraft. Is this possible?

  • The bank seems to be a law unto themselves these days. I would open up a parachute account at a different bank just in case before you start the process. Answer to your question is basically yes they can, they can also give you 30 days notice of account closure. Sorry

    I shouldn't worry too much about them calling in your overdraft.

    A & L have decided in their mean spirited, spiteful and vindictive manner to close my son's account after we got money back from them
    I quote from their letter:- "If you have an overdraft facility..... we will contact you separately regarding the removal of the facility and for your repayment proposals".
    Which basically means that YOU have to agree between you and the bank at what rate you settle any outsatnding overdraft !

    In retaliation the whole family, another 5 accounts, are leaving A & L and moving to other banks who offer £50 to open an account with them.

    Greed doesn't pay A & L ! May your shares plummet !

    i am considering claiming back charges, problem is i do not have all past statements going back 5/6 years to check all charges i have incurred.
    any ideas on how i can get this info?

    write to their data protection dept enclosing a cheque for £10 asking for details of you last 6 years statements.

    I think it more than likely depends on the bank. I had a reply to a question i asked on the BAG asking whether or not Nationwide close accounts if you claim charges back. One guy replied saying they closed his account and told him he had to re pay all the overdraft which he ended up Browning from Friends and family to pay this.

    I agree that you have to repay the overdraft but I would still think that as they are calling it in that you would have to agree between you the actual terms of the repayment.
    It may well be that the tone of the letter was "threatening" which made the person in question think he had to pay it all back instantly. I would certainly call their bluff if they said/implied that any overdraft had to be repaid immediately.
    I daresay they said that their terms and conditions were "reasonable" - but they still paid up !!

    Just to keep you up to date i have finally saved the £80 court fees to take lloyds to court for £750 i will keep you posted as lloyds seem to be the one's that fight this the most.

    Just have to save another £80 to take cop on to court.

    Does anyone know how they give you your money back is it credited to your account or do they send you a cheque??
