  • Isn't that like acknowledging the debt tho?
  • No. You're just trying to establish whether the debt is yours or not ;)

how do I find out when I last made a payment to the companies ? will it show on my credit file? If for example it's 5 years then what do I have to pay them?

Can you not work this out from getting bank statements?

You do have to be careful here - a letter saying 'can I have copies of my account statements' is an acknowledgement of that account.

If there's no other way, then this is a rare occasion where a phone call might be better as that does not count as acknowledgement. Otherwise you should use the phrase 'I do not acknowledge any liability to your company. However, to aid me in my investigations...'

Heading the letter 'without prejudice' is sometimes advised but, without going into details, I am not entirely happy with it.
  • Hi all, I used the letter from this thread in relation to a debt of my partners which he had been told had been wiped 15 years ago following a breach in contract by the finance company. So we were very surprised when we started getting letters from Mackenzie Hall and I told my other half I would look into it. Thank you for the letter.
I sent it recorded delivery and it was signed for on the 21/11/11 so hoping this will be the end of it.
Just wanted to thank you all! Will post if I hear anything from them!

The post before mine makes an excellent point.

If it's 15 years, it'll be well and truly statute barred, which means you don't have to do a thing.
  • They chased me for a sixteen year old debt and I told them I'm not paying it. So far its been sold to three debt collection agencies in a six week period.

Over the last 10 years (!) McKenzie Hall have been chasing me on and off for £750, which they say is owed from 1994 but they can't tell me who the money was owed to or send me any proof. I contacted Which legal service who helped me write a letter to MH, similar to the ones on MSE, which stops their letters for a year or so each time.

I've just received another demand from MH saying that if I don't pay then a doorstep collector will come and collect the debt within the next few weeks.

Funnily enough their letters always seem to come in November/December. It's getting to be one of my seasonal jobs - declutter for Christmas, buy pressies, send out cards, send letter to McKenzie Hall.....:)

Edit: I don't sign the letters to McKenzie Hall, just print my name.

Or it's just cycling through the various half dozen "trading styles" of the same one.
