This might also be relevant if you have not paid for this debt or acknowledged it since April 2002

Thanks Fermi & RAS. Just checking out the link now. I have not acknowledged the debt (:o) in any way shape or form, unless a statement on MSE counts :rotfl:
It was something from my stupid era, paid with a check on a dormant account. Cheque amount was for £36, fast forward a few yrs, with fees they wanted me to pay over £700  My Maths sucks at the best of times but the fees alone account for over 90% of the debtDEBT FREE AND LOVING LIFE0 -

I have been paying MH (i know, stupid) £40 a month for the last 6 -9 months. Where do i stand on this debt. Do i have to keep paying it.
Can someone help0 -
David
Welcome.
Two things we need to check.
1. Have there been a gap of 6 years between your initial payments (or non-payments) and the paymnts you commneced 6-89 months ago. At any time?
2. if this is a credit card debt rahter then a bank account debt, have you requested the Consumer credit Agreement? If you've have not made a mistake, you've made nothing0 -
RAS. I am not sure if there has been a gap of 6 years. Certainly, MH have only been on the scene for the last 12 months, before that it was RED. Before that someone else was trying to get money. I have tried to stall them over the years with token payments.
I have not asked for a cca yet as i am waiting to hear from them now i have canceled the direct debit.
To tell the truth, this debt has been passed from one debt agency to another over the years, probably 6 or 7 in total. The chances of them having the CCA is quite remote i would say.0 -

If you have had nothing to do with this debt since 2001, then it is likely to be "statute barred" and legally unenforceable.
From a previous thread:
A debt will be "Statute Barred" if there has been no acknowledgement of the debt by you making a payment or in writing within the relevant limitation period.
If you are in England/Wales then the limitation period is 6 years and you should read:
Link: Factsheet | Liability for Debts and the Limitation Act (England/Wales)
If you are in Scotland then the limitation period is 5 years and you should read:
Link: Factsheet | Liability for debts & the Prescription & Limitation (Scotland) Act 1973
If you feel the debt is "Statute Barred", then there is a letter to write at the end of each factsheet.
