    can someone help me as regards of a letter to send to them explaining i will not be paying this debt bearing in mind 2 hours ago as i have said before i have agreed to pay this debt on the 26th of this month for the sake of 106 pound would it be better to just pay it to stop them sending people to me home for debt collection

    Police cannot be sent to your home or get involved in any way for a civil debt.

    It doesn't matter what you said over the phone either.

    You have contacted me/us regarding the account with the above reference number, which you claim is owed by myself/ourselves.

    I/we would point out that under the Limitation Act 1980 Section 5 "an action founded on simple contract shall not be brought after the expiration of six years from the date on which the cause of action accrued".

    I/we would also point out that the OFT say under their Debt Collection Guidance on statute barred debt that "it is unfair to pursue the debt if the debtor has heard nothing from the creditor during the relevant limitation period".

    The last correspondence/payment/acknowledgement or payment of this debt was made over six years ago and no further acknowledgement or payment has been made since that time. Unless you can provide evidence of payment or written contact from me/us in the relevant period under Section 5 of the Limitation Act, I/we suggest that you are no longer able to take any court action against me/us to recover the alleged amount claimed.

    The OFT Debt Collection Guidance states further that "continuing to press for payment after a debtor has stated that they will not be paying a debt because it is statute barred could amount to harassment contrary to section 40 (1) of the Administration of Justice Act 1970".

    I/we await your written confirmation that no further contact will be made concerning the above account and confirmation that this matter is now closed.

  • Hi, My OH received a letter from mackenzie hall asking him to ring them. He called them this morning and they say he owes £1200 for a past debt. They asked a lot of questions etc and asked for immediate payment. My OH thinks that the debt is over 6 years old but they are saying that it was passed from the Halifax in 2003. No payments have been made for over 6 years, and as far as I am aware my OH has not contacted anyone about this for over 6 years. What I really need to know is whether this makes the debt an old debt and not repayable or not. The other thing is that my OH has no records relating to the debt so exact dates etc are not available. If anyone knows the best way to proceed please let me know.Thanks

    i have just received what looks like mackenzie halls new means of getting people to phone in - its a blue tear off envelope and when you open it it states this is not circular or junk mail - we need to speak to you urgently and gives references.

    Now i know its junk because although years ago i had previous debt i have infact spent 7 years tied in to pay outstanding debt and this was all in my maiden name - i have also spent years not having any other debt - no credit cards etc - the letter is in my new married name which i have no debt with -

    has anyone else recently had this new circular blue letter?:mad:

    Sounds like one for the round miscellaneous file.

  • Hi Newbie here! i have just recieved one of these blue tear off letters from macenzie hall,
    I have no intention of ringing them.
    The letter was adressed in my maiden name.
    I believe that this may relate to a debenhams card i had 10 maybe 11 years ago when i was young and stupid,which i am ashamed to say i havent repaid in full since moving home 9yrs ago
    at most i think the debt may be £500
    but i know i havent recieved any correspondence re this i suppose it would of gone to my old adress it may of even gone to court for all i know.
    dont know what to do for the best bin it or put it aside
  • Hello, I would appreciate some help please.
    I received a letter from mackenzie hall about a debt from 2004. I paid off some of it at the time and then the collectors went quiet with no phone calls, letters or attempts to take the debt. It's now 3 years and I got a call from mackenzie hall randomly 2 weeks ago asking for payment. I told them I had been dealing with another company which then stopped contacting me and the woman demended payment immediately. I told her I only left finished uni a month ago and wasn't in any position to pay but sheinsisted that I pay within 7 days. It's 2 weeks now and I've been ignoing them but received a leter from their litigation manager today saying they were sending their officersto my house and from there will be taking me to court if I still don't pay.

    I really don't know what to do. Thank you
  • i have received a letter but mine was in a brown envelope now it doesnt say how much i owe or anything now i ordered something in my fella surname and now i am abit worryed wot shall i do my fella knows u used his surname but this letter seems strange plz plz help

    This is statute barred, unless there is a CCj outstanding and even then they would have to take you to court to get permission if the CCJ had not been activeted after 6 years and would be most unlikely to get permission.

    Send the letter fermi put up for MAtty and you will be OK.
