Seriously considering going bankrupt ! Help!

    Hi everyone...not been here for a while,so little update.

    So,I went to see the CAB debt people and the young man gave me what I thought was some very good advice.
    He said to stop any DD's that I needed to and when they write asking why,to send them a return letter,explaing my circumstances and offering them a minimal payment (£1 a month). This has something to do with a legal technicality apparently.....shows that you are 'trying' to make payments....
    He also said not to go for bankruptcy just yet. He said to wait for the mortgage people to make their move for re-posession and then go to bankruptcy. All about timing,he said ! Seemed to make sense to me. He gave me some 'template' letters to send o my creditors.He also said to ring him directly if I needed any help with anything. He seemed very helpful and reassured me that I'm not alone in this. He said that he'd seen a LOT worse than my case,too.
    We agreed a 'plan of action' , so will now have to wait to see how things progress. Rather quickly,I would imagine,as I've now stopped a bunch of DD's including the credit card and personal loan (with my own bank).
    I've also set up a new co-op cshminder account and drawn out as much cash as I dare from my bank and credit card,so the brown stuff is likely to hit the whirly thing any second now !! :rotfl:
    I have also had to 'sign on' as the work situation has ground to a halt. The whole credit crunch situation is making things ten times worse for just about everyone,so I don't know where we're all going to end up !
    I'm trying to sell some of my stuff on e-bay and various other places,to raisey a bit of spending money. I also have thought about maybe doing one or two car boots,to see if that will work. We'll see how that goes.

    Oh and I've been in touch with my mortgage provider,re missed payments and they have surprised me with their considerate response ! They have asked me to send them my proposals for dealing with this. I had already suggested 'freezing' the payments and not adding any charges until january 09. I would have thought that they would have gone straight for re-posession,but it seems not. I think it helped that I pointed out to them that they too would lose out big time if they went straight to re-po. See how this progresses....

    So,now 'the game' is in play,as it were,so we'll see where all this leads.....

    Hi Jeff, sorry BR day tomorrow so been sorting out the forms online etc.

    Will reply again tomorrow as I need my bed, whether I sleep is another matter.

    I would still also suggest you ring Nat Debt line to be honest with you, you may get more answers to your questions.

  • As your debt isn't so huge, could you look at other options? You live in a 2 bed place, could you get a lodger? If work's slow at the moment, a weekend job in a pub?

    Those two together could bring you in an extra few hundred a month.

    Hiya Jayen

    I only started on this forum last week, and up till then had NEVER copy&pasted, so you aint alone!!

    Go to makesenseofcards, choose the SOA form and fill it in. At the end you have to click on CALCULATE. It does the maths for ya. You can save it on the site (I think), but I saved it onto my computer to be safe. To get it onto the MSE website I went the long route as I kept losing the damned thing.

    SO! I opened the MSE site, then minimized it. Then opened the MSOC site, did form, clicked on FORMAT FOR MSE, went to EDIT on tool bar and clicked COPY then highlighted all the text, then maximised the MSE site, opened me new posting, and clicked EDIT then PASTED. As if by magic it all appeared, and I almost fell off my chair :)

    If you already knew how to do all that, then indulge me... I'm showing off my new techy prowess!!!

    I am already advertising on 2 'rent a room' type sites,but no takers as yet. Dunpayin, I have already posted an SOA earlier in this hread (I think),so take a look.

    Rylynn....I thought you were already bankrupt ?? Seems not tho'. By now you will have been to see the 'bogey man' :rotfl: , I hope everything went well for you. Do let us know ?

    A bit of further news from me..... Opened a letter today from Npower, only to find that they're going to increase me DD for my electricity from £60 a month to £99 !!!. :eek: What the HELL !!??? I can't see how they can justify this ! As though I don't have enough problems.... Where's the nearest cliff ?? :mad:

    Well....hello everyone. I'm back ! :hello:

    Things have moved on a bit. The mortgage company have now said that are going to go for re-possession. I have asked them not to,as I have put the house on the market for sale,so hope that I can 'get in first' before they do. I had some work before and around christmas,but that has now dryed up completely ! So,I am signing on again. :( I sent some letters out to my creditors,offering £1 per month (as advised). My bank (Yorkshire) have accepted this,on my personal loan,but the Visa card people (also Yorkshire) seem to be trying to ignore me ! I am also trying to clear out /sell some more stuff,ahead of the looming sale / re-possession ! Given that I will be 'homeless',I am trying to prepare a half finished 'motorhome',as somewhere to live ! I will be going to see the people at the CAB again next week,to see what else can be done.
    I have one question for you knowledgeable people on here..... At the moment,I can't even afford the fees to declare myself bankrupt.....how do I proceed here,can I force one of my creditors to make me bankrupt ?? If so,they will pick up the bill for that !
    Anyone ??

    Creditors will try every trick in the book apart from making you BR it costs them much more than you would pay yourself....the only people that would are council tax/HMRC/AMEX

    some of the utility companies have trust funds that might be able to offer help...although due to the increase in people going BR they're refusing a lot of applications...worth a try to see though

    Please note you will usually need the assistance of a recognised Debt and Money Advice Worker in completing applications relating to the above.

    Could you explain a bit more about these trust funds,please ?? I've not heard of anything about this before.
