    Hi Debtman,
    Voluntary charge is where you OFFER a Charge on your property as security against the money you owe to a Creditor.

    1st Cretins like these cos that means that you cant move house, raise money or anything without paying them back!! It also means that if you go into arrears with a repayment scheme then they have you by the short and curlies!!!

    Just checked OFT website and the above wording seems to breach Section 2.2a and b misrepresenting the information given to a Debtor as though it has come from the Court ( not exact wording, but gist of it ).

  • Another letter received today as follows:

    We write to introduce 1st credit to you.

    CITIfinancial has assigned to 1st credit the full outstanding balance which is due immediately.

    do not make any payments to citi

    you should make contact with this office immediately so that we can agree payment terms with you. faiiaue to do this will result in more formal recovery proceddings being taken against you.

    in accordance with the data protection act 1998 we will comply with any request for a copy of the personal information about you that is held on our computer syetem

    send your request along with teh administartion fee of £10 and a sae to teh above address.

    please do not ignore this letter


    So what is that all about?? They have already sent me a notice of asignment and i have already sent a CCA with £1 postal order and asked CCCS to send repayment proposals.
    Should i take any action on this or just file it with teh rest of teh gumpf they said out. Is this just anither ploy to get me to phone them??

    Did you mention in previous posts that you have two Citi cards? If so, this is prob to do with that maybe?

    Update on 1st Crudit and SD, They signed for Rec Del of CCA req today. CCCS view is do not acknowledge the SD in ANY way as its prob just a frightener espec as it was just in the ordinary post. Also, just about anything that can be done NOW to stop it is exactly the same that could be used at Court if they tried to take it any further ( assuming CCA correct ). The CCA req expires on their 18 day response limit for SD.

    Yes but i have requested CCA's for them both already so not sure what this si all about. maybe another to get me to phone them perhaps/

    Aha! You are assuming that the parasites left hand knows what the right hand is doing....its prob for the 2nd account, dont ring them, it may be worth CCA req for this one specifically.....or have you already asked them with the 2nd account number?
    If you've had a negative reply mentioning BOTH account numbers then I would ignore this letter. Just add it to your file cos they're hands are tied anyway.

    Yes this is definitely for the 2nd card as it has the account number on.

    Just to clarify i have sent two separate CCA requests, one for each card already. 1st card has past 12+2. 2nd card is about 7 days into 12+2.
  • I have had yet another letter from 1st Credit Ltd.

    First, a reminder of where I am up to - Sent CCA request & £1 by recorded delivery on 1st September 2008, which was signed for on 2nd September 2008. Received a letter a few days later from 1st Credit enclosing notice of assignment (dated in September 2008!!) but also explaining that they did not hold a copy of the CCA and had asked the original creditor to supply it.
    On 18th September, I sent the 12+2 letter by Recorded delivery and again, a few days later received the same reply as previous - they did not have the CCA but had asked the OC for it.
    Yesterday, I received a letter from 1st Credit under the guise of LCS solicitors stating that unless full payment is made within 14 days, they are instructed to commence proceedings in the county court against me.........bring it on, I say. Still no sign of the CCA.......

  • They send me various letters but worded differently which all amonunt to teh same thing. They do not have the CCA and have asked the orginal creditor for it. They just do not take any notice of the letters i send.

    i guess my next letter will be from LCS also. Are they their in-house solicitors??

    Hello again,

    Following on from prev posts. after the SD from 1st Cetins, sent the CCA req which was signed for on Thurs. Had the following reply from 1st..

    Sir/ Madam, ( so its a computer gen standard letter then )

    I refer to your recent communication ...that you have a dispute/querry in relation to the debt.

    we will be contacting our client to advise them of your comments. We will contact you with our clients reply in due course. This process may take at least a month.

    unless you are querying the full balance we must ask you to contact us immediately to discuss payment of the debt amount you accep is due and payable.

    please call this office to provide a suitable contact number.
    This will ensure we are able to deal with this matter quickly and efficiently.

    ADMINISTRATION DEPARTMENT.

    I'm reading it as this ( I have NOT acknowledged the SD )...
    We know that there is a pretty good chance that a correct CCA will not be produced at any point so now we are going to try and get you to admit your liability over the phone whilst you have a CCA request with us or 'appear helpful' and at least try to squeeze something out of you.

    Or am I being cynical??:rolleyes:
