It's a beta for goodness sake. Of course it's going to have bugs.
How are they supposed to test it without letting anyone use it?
This seems extremely early to have gone to a widespread public beta. The features that are missing, I would have expected them to be introduced through targetted releases within the community to a more skilled testing group then the final 'spit polish' betas to have gone public before general release.
It almost feels like they've rushed to get this out to steal the thunder from IE8.0 -
Another reason for me to leave it alone, I don't do bets testing. Besides, I have just started exploring FF as an alternative to Opera, but I shall watch with interest to see if there is a "must have" feature.It's a beta for goodness sake. Of course it's going to have bugs.

They are encrypted by default, but easy to get if you don't user a master password.
If you do use a master password then they are secure (as much as most things are anyway).

Terms like that have become increasingly common since the advent of "Web 2.0", though they tend to disappear when enough users complain about them. I think Bebo and Myspace used to have similar terms. Facebook still does, as does Yahoo (so by posting a photo on Flickr, you grant Yahoo the right to use it forever). I've never seen it in a browser though.
I don't imagine there's much chance such a thing would be legally binding or enforceable. Still, pretty sneaky trying it on like that.0
