What can she do....?

My daughter has sold an electric trike on ebay,buyer collected it,she wanted it covered etc,so kids could'nt see it,she was advised to look at it & try it,but she refused.took the bike.then buyer phones my daughter 2hours later to say there is a problem as the back wheel won't go round,but it was working fine when sold.daughter advised buyer to fully charge bike.buyer then phones back to say hubby has taken the back wheel off,and says there is a problem with a cog etc?now,the buyer lives over an hour away from my daughter,and my daughter does'nt drive,so they have a problem,as i think buyer is refusing to drive back with bike etc...so there stuck at mo,my daughter is willing to give money back,but she is then stuck with a bike with wheel off etc....any ideas? :confused:

    IMHO if you are 100% sure the bike was in full working order when sold tell them sorry
    you should have returned the bike before you started tampering with it.

    They could have broke the bike when they took the back wheel off.

    How did they pay for the bike Cash , Paypal or cheque.

    I agree - if they bought this from a shop then tampering with it like that would certainly invalidate the warranty and it should be no different over ebay.

    The buyer had the chance to try it before she took it away and refused and even if it doesn't work as she is stating she shouldn't have let her hubby tamper with it. Your daughter should tell her that as she has tampered with it she won't get it back in the condition it was sold therefore no refund will be issued. Its obvious your daughter will get a neg for doing so but your daughter can reply to it with the facts that it was sold unseen as buyer refused then buyer wanted refund after taking it apart. If I was a buyer reading that it wouldn't concern me at all.

    I know that when you buy from a shop you don't try things before you buy them but in this case common sense should have told the buyer to try it and not tamper with it then complain.

    Sounds to me that she is trying to pull a fast one!! she wants you to give her a partial refund so she doesn't pay the full amount for the bike! If you call her bluff and tell her to bring the bike back she will get hubby to then take the wheel off and mess a cog up!! Up to you what you do but If you are 100% sure that you sold the bike in full working order then tell her! She shouldn't have tampered! she should have tested it etc....sounds to me like she knew what she was doing from the start!

    buyer payed by cash,and bike was working 100%.....update.....the buyer is willing to see if parts can be obtained or can be repaired,and she will have a discount on bike,seems a good offer to me.......finding out on Wednesday......thanks for all your replies......

    They could have tried the bike before they left,
    Also you are 100% sure it was working.

    IMHO i would tell them to get lost .

    Yes I would say that too. Plus they have tampered with it so who's to say they have stopped it from working properly themselves?

    If the bike had been sent by mail or courier then the buyer would have a genuine gripe. However, they picked it up, refused inspection (even though they were encouraged to check it) and then tampered with it.
    IMO that's a done deal and the words "sold as seen" spring to mind.
    There is no way on earth that I would give this buyer a refund, partial or otherwise.

    Agree with everyone else. As I said before, you asked her to test it....she didn't want to....why should you refund even a penny after they have tampered with it? Agree with angelcake when she said it sounds like your buyer knew what she was doing from the start.

    Hi Fuzzy,
    Don't be taken in by this silly/unscrupulous buyer.

    You know the bike was okay and by refusing to test it they have agreed to buy it as it was (even if it was broken).

    By taking off (or saying they have taken off) the back wheel they have lost any right to return it, although since this was a private sale they have no rights to return it at all.

    They paid in cash so cannot retrieve their payment by any legal means.

    I'd tell them 'sorry, you had the opportunity to test it and decided not to', and would refuse to refund them anything or accept the return of the bike.
