Solicitor slow over probate

:beer:Sorry Maggie
Forgot to say - thanks for the congrats.
And what were you doing in a judicial review. Not to do with S1?
Have a good weekend0 -
I suppose people could if they wanted to be sued for libel. The site appears to have been designed by a 12 year old with a potty mouth and no spellchecker.
As for the state of the Solicitors from Hell site, if it prevents just one person from using this particular solicitor again, it will be worth it. After all, the shares are next to worthless now.
What is most upsetting is the thought of how the deceased would feel about the situation, having believed that they'd left their estate in capable hands.0 -

Hi Trix, LOL, if only! :rotfl:
I have ME and two patients managed to get permission to go to Judicial Review over the NICE guidelines. While a Review can't look at the scientific evidence and papers, it can look at procedural irregularities in the setting up of the Guidelines Development Group and their decisions. So basically there were two arguments - irrationality and bias. Then on the second day another "Interested Party" had another barrister who argued on the cost-effectiveness of the two therapies (Cognitive Behaviour Therapy and Graded Exercise) NICE recommended in their guidelines for CFS/ME. Judgement has been reserved, so not sure when we'll hear what is decided.
Was completely knackered after 2 days in a stuffy courtroom, straining to hear the Plaintiff's barrister, NICE QC (trust them to have a QC!) and the Judge. Sitting in the wheelchair for 2 days more or less all day has played havoc with my back, but it was good to go along to show my support for the plaintiffs. Have since been transcribing the notes OH and I made, and I still have some to transcribe from the second day of the Review.
There's a thread about it here.
Will update on probate etc news when we get back home (we're driving back today), as haven't got the paperwork with us that I need for accuracy. All I can really say is that it rather looks as if S1 hasn't sent all of the paperwork to S2, but will have to make some phone calls to at least one beneficiary (my cousin) to check that she has had her inheritance and also sent back the receipt enclosed. I know my daughters have sent back the receipts.
Best wishes from Herne Hill, where we've been sleeping on our daughter's floor.

Hi Maggie, Sorry to hear you have ME. A friend of mine has it and is very ill. My admiration for you - dealing with all the S1 stuff - knows no bounds. Hope it is moving along a bit. Yep - somehow the highly paid solicitors always need you to second guess what they will and will not send out. We are still trying to work out if we have all the documentation to be able to sign off the Accounts. We suspect not - and are going to pursue this next week. Strange that their reverence for the law only extends to their own contracts and not to the stuff they send you. It is clearly not acceptable to ask us to sign things without proper knowledge of what you are agreeing to. Only our solicitor would think it was.
Anyway take it easy and enjoy this sudden bit of sunshine. BBFN0 -
Hi there Folks,
Been a while since I updated. Been various letters and phone calls - some just documents to sign etc.
S2 has now paid out all the remaining pecuniary beneficiaries - daughters have had the remaining half of their inheritance, plus husband has had his from my mother.
Letter yesterday from S2 enclosing new valuations of shares from different brokers, showing value at probate and value now. (depressing! )
Also saying their brokers feel that a lot of the probate valuations were wrong.S2 on holiday now, but will discuss this with us on return from holiday, I think next Friday.
Isn't life interesting?
Trix, I hope things are moving forward for you too - any luck with getting the documentation you need for the estate accounts?
I've not been a good money saver since I last posted! Our bedroom TV was dead when we came home from London, so we indulged in a 32" HDTV with Freesat for the living room, and our old Sony is now in the bedroom. Guess it's not such a dreadful thing to do - I hardly ever go out, so it's good to have a decent TV. Probably "pay for itself" in a year or so compared to the amount we'd spend on going out etc if I was able to. If you see what I mean!
Still feeling very strange that all of this is still struggling on so slowly. We will have one hellova party when it's all over! Though think I need to read some Dickens - Jarndyce v Jarndyce is the case I'm thinking of. You can find Bleak House here.
PS we've cancelled Sky, so that makes the TV a bit more money saving! :T0 -
Hi Maggie,
We have signed off on the final accounts and got some of the tax documents back. But as yet no follow-up and none of the promised copies of things I asked for. You have just reminded me to have another go at getting them. Honestly - I spend most of my time trying not to think about things - Especially share values - - they are just too depressing.
BTW - don't worry about your TV - you deserve a treat (in fact more than that). Hope the HD telly is good! My kids just bought me a wii for my birthday, and I have arm strain at the moment:rotfl:.
Take care.

Oh I know what you mean about trying not to think about things! I am dreading what S2 is going to discuss with us when back from holiday. (wish there was a "scared and shivering in my shoes" emoticon!)
According to S2's brokers we're around £78K down on the shares. But guess I shouldn't complain - I wasn't actually expecting to get anything at all from my parents - let's just say we didn't have the easiest of relationships. It's hard being an only child.BTW - don't worry about your TV - you deserve a treat (in fact more than that). Hope the HD telly is good! LOL, I hope your arm is healing well - nice to have such a super prezzie from your kids. :j The HD tele is really fantastic.Just wish I had the energy to stay up late enough to actually watch the HD broadcasts - since we bought it I've mainly been in bed before they start (sleep clock really messed up at the mo) but have watched loads of their preview stuff in the day. New toy, so watch the adverts for the programmes even if don't get to see the programmes.
Husband wrote to S2 after last letter asking if they knew if S1 still has any of the Estates money... Suspect he has, will have hung on to some for his bill I imagine. Which we will be querying since he's made such a mess of everything. But we'll cross that bridge when (if) we come to it.
Good luck with getting the papers you need back.
All the best, Maggie0 -
Hi Maggie :-] Sorry not to reply earlier - but still not finished. Still don't have the copies we should have, and no news from the solicitors re tying the whole thing up. Why am I not surprised.
We understand the only child thing - as OH is an only child and we had wished we had help with his parents, but now think it made things simpler. As the solicitor's delays would have caused more friction - no doubt.
Best wishes - T0 -
I tried to update yesterday, but for some reason it didn't work. Mind you, am having some problems with my laptop which hangs on bootup rather a lot.
Just glad can use husband's laptop when mine refuses to work!
Friday husband had conversation on phone with S2.
IHT - 2 cheques received so far from the Revenue.
Has looked at papers from S1 and the final accounts he was preparing before S2 took over.
The amounts S1 was planning to charge for his time do not look unreasonable to S2 for the work he did (although we may wish to have some reduced where S2 had to repeat the work).
So since S1 is co-operating with our wishes and doing everything promptly now when S2 asks him to do/sign as an Executor, S2 suggests we don't go for a showdown yet.
Stuff about de-merged shares that happened since parents' deaths.
S2 will think about making another payment to me as residual beneficiary.
Will also send us letter with interim accounts including S1's work.
So things are moving on slowly. Will update when we have more news.0 -
I just wanted to add briefly my experience.
The solicitor dealing with the probate of my MIL's will allowed our brother-in-law to steal £20,000 from us and our children.
It took two years to get paid out over a very straight forward estate. The last six months delay was due purely to the transfer of a couple of shares.
On checking with the company dealing with the transfers said they had not even heard from the solicitor and that the transfer would only take a couple of weeks.
Yes I know I should have complained but after 2 years of hell I didn't have the energy.0
