Creation financial services - help!

Years ago i had an Allders account store card, Allders closed down and my account was taken over by Creation financial services. I have not used my card since Allders closed down four years ago, yet i still owe the same amount i did four years ago. I spoke to them years ago and i arranged a payment plan to pay it off as i was having financial problems. For over 3 years i never recieved a statement off them, and they kept telling me to check with the post office!??! Then one day all of a sudden i started getting them through the post, and was shocked at what i still owed, as all this time i thought i was under a payment plan and i wasnt! they also said they had no record of the plan. Obviously not recieving statments i was getting late payment charges as i did not know the correct date of payment, or even the correct amount. Surley this is unlawful?? I can not afford to pay more than that because of my circumstances. What can i do? i am still paying alot of interest for purchases made 4 years ago. Originally the agrement was with Allders not Creation. I really need some advice.

    I would contact CCCS or Citizens Advice Bureau.

    They may advise just requesting a copy of your credit agreement - if they cannot produce it then the debt will be unenforcable. Not sure if you would be able to reclaim the charges as Allders are no onger in business.

    Also check your credit report to see if there is a default on your file.

  • All the charges were after creation took over, everything was fine until then. I just cannot see a way out of this debt, it just is getting bigger than small and i haven't even purchased anything since begining of 2004.

    If you look at the bank charges forum, you will see that they are not allowed to profit from any charges, but that the charges should be in line with the cost of informing you of the late payment and cost for processing. As they never contacted you i would ask that all charges be removed from the account - if they do manage to produce a copy of the CCA.

  • Creation did not take over the Allders card when they went out of the business.

    Creation was the card issuer; the card was Allders Financial Services provided by Creation Financial Services. When Allders went bust, for legal and business reasons AFS was taken away and the card just by CFS.

    Your complaint and issue will me with CFS so you are still covered and able to get information out of them

    Hello
    Can anyone give me advice please.
    I have just today received all my sisters statements from the last 6 years to claim back, however the wording is very confusing,

    details are as follows-

    Pre approved limit Increase
    Service Charge at 2.2% per month
    Credit Limit Increase
    Late Fee
    Interest
    Interest for purchase
    Unpaid Direct Debit
    Unpaid Direct Debit fee

    Any advice to which of these can be claimed back would be very helpful.
