Claiming after accident

Another driver hit me, my insurance provides legal cover and theyre creating a claim file for me. As well as back pain I'm also in a position where revision for upcoming university exams is being disrupted because of all of the paperwork, phone calling and general stress of the whole affair. Am I able to include this in a claim, as failing will mean I have to retake the year, costing me a potential £6000 in tuition fees and maintenance loan? :cry:

    I would discuss it with your insurance firm or insurance provided legal guys, as they will more likely know what you can add to the claim and what you will eligable to claim for that you may not have thought of. The claim may be dependant on your results and that would protract the procedings longer than otherwise.

  • To be honest there shouldnt be a large amount of paperwork involved with your claim. What sort of thing do you mean?

    I work for insurance companies and so therefore I have to say that unless you can prove it, then this it isnt something you can claim for.

    Obviously any injury you are suffering, or if you are injuries are such that they are affecting your studying then they could be claimed for, but again you will have to provide evidence.

    It's not soley the paperwork.

    I'm not sure how I could prove this but I certainly wouldn't want to fail and rack up a £6000 bill on a re-take, but if I can't block the incident out of my head and focus on revision then im screwed.
  • If you are stressed because of it then really you need to make sure you are visiting your doctor to get help where possible and so that a written note is made of it.

    My legal cover advised me to put in claims for all out of pocket expenses after an accident, which I spent ages sorting out.

    in the end, I only got my excess back as apparently the third party is not obliged to pay the extras, therefore my insurer refused to waste time pursuing it.

    Maybe you would be more successful with a doctor's note though.
  • Thanks for your input andyrules, can I just confirm what you're referring to by "extras" though? i.e. they're liable for the vehicle if at fault, would personal injury be an "extra" and if so does the definition of this term include expenses occured via that injury, be it physical or psychological?

    I can't say I've ever come across such a claim before, but if it was presented to me I'd be highly sceptical and would want some evidence that you failed your exams solely due to the accident and not other factors. At the very least I'd want something from your tutor saying that prior to the accident you were on course and would have every likelihood of passing this year.

    I dont know who told you that but usually out of pocket expenses are taken into account in the claim settlement

    I cant see a claim for your £6000 tuition fees etc being paid given your post. Fair enough if you were in hospital for many months but not for just filling out some claims paperwork and phonecalls.

    Your injuries dont appear to be serious and you made no mention that these were affecting your studies.

    I would certainly dispute a claim of this type if it was presented to us, you could have done no revision whatsoever and simply looking for a get out clause.
