Ex has taken our car and wont pay me share

Hi, can anyone offer any advice please? My ex boyfriend and I purchased a family car together. I paid for the car, (£18,500), initally using my savings as he wanted to get a better price for his old car selling privately. I have proof of the cheque coming from my bank account and also his car sale proceeds (£9000) being paid back in. We put the car in his name at my address as I already had a little 2 seater car. Hes now left taking the car. I sold my little car whilst we were together and so was left with no car. Now Ive had to buy a car on finance as my savings are gone. Is there anything I can do to get my share of the car back as Im struggling with finance payments, while he has our nice finance free car to run around in. Hes says I can forget it, the car is in his name, its his. Please help.

With him and that attitude, you would be looking at court action, and that only. Sorry.
Registered keeper does not mean legal owner, but you would have to prove you paid directly for the car and you have the paid for reciept, all in your name. I suggest you gather all this info together and speak to a solicitor on a free half hour or CAB. If your evidence is good, then you should be able to got to court yourself (there are limits to financial claims in this instance). Even if you were to win a court case, if he claims poverty then you may find yourself being paid at a pitance a week forever.
Not the bearer of better news, its a crap situation but as the car is in his name its your only route available to you in law.
Outside the law, there is the option of a few burly mates with a big stick...... but can't really condone that!0 -

I'd try writing him a polite letter, asking him for half of the money because you paid for half of the car, so it's only fair. Go onto www.whatcar.co.uk , and in the used car section, find out what the car is now worth (it has all makes and models, and you can enter the approximate milage), then print this off as evidence of what he should pay you.
Also in the letter, point out that being the registered keeper doesn't mean he's the legal owner, so if it went to court, he'd have to also prove he'd paid for the car outright, which he wouldn't be able to do.
Tell him that you wouldn't want him to have to pay all the court costs too, so it's easier if he just pays you half of the current car value, and you'll call it quits.Should've = Should HAVE (not 'of')

He sounds really....not nice!! As mentioned above - his name on the registration document means nothing. I could ring up the DVLA and ask for a registration document for your car as 'I had lost it' honestly - he hasnt a leg to stand on. Did you get a spare key? I would just go round and get it if you do. If not, unfortunatly you may have to go down the court route. Good luck though hun xxXx0 -

There are many decent blokes out there who don't want to pull this kind of stunt. Unfortunately, the women are often not interested in them until they have been ripped off and given a brood to drag around [often several times over]. have to second this, in work we had a van written off, silly me assumed insurance company would inform DVLA they owned it and had written it off but no it was a category D write off apparently so they passed it to a salvage company who were able to get a tax refund without the V5 document
cut a long story short after weeks of arguing with DVLA after they tried to fine us for no tax for a vehicle we didn't own and had been written off, they admitted yes anyone could turn up and say the v5 was lost sign a form and a new one would be issued in their name..................beggers belief but there you go!Norn Iron Club Member #64

actually if you wanted to play dirty heres what to do
go to dvla get new v5 for it
take your receipt/V5 to dealer, pay for key code for spare key (assuming it doesn't need the car there to have it programmed)
go to ex's house............take back car.............
but then I'm sure world war 3 would start, up to you, how much do you value your money lost, if you follow this action you may well have police at your door if ex reckons you've "stolen" the car..............but having a V5 and a receipt may lead them to class it as a domestic and walk away if they're anything like the police round here!Norn Iron Club Member #64

Is it really that easy to get documents? Could I just choose my next door neighbour and gt the documents to his car if I so wanted?

pretty much - that was my argument with DVLA when I rang how could they give a tax refund to someone not on the V5 and in typical civil servant mode they said "because the person signed the form to say the V5 was missing and they were the new registered keeper"...........there were no other checks carried out at allNorn Iron Club Member #64
