Can I make the bailiffs leave me alone if the amount of the debt is in dispute?

Certainly a thought, Aylana - although they will probably argue that the time to 'dispute' would have been when it was at court.

I must admit that I am not too sure how it goes with 'Magistrate Court' hearings and whether you can get the judgement 'set aside' in the same way as at a County Court.

    Certainly worth asking herbie, though.

I was going to post that it would be a good idea if Bailliffs studied and got some sort of qualification so that they knew what they were doing, legally speaking, however maybe its a good idea that they continue to employ he usual meat-heads so that their mistakes can be used against them.

That said how many people are scared into god-knows-what by them when it was not neccessary? Where do we complain about a particularly bad Bailliff?

Lots of interesting information here. It will be interesting to see how the case with the car goes tomorrow!

We will see if we can get the statements from the council and bailiffs and see what sort of figures we are looking at.

pepe I agree that Bailiffs should have more training and I think they should be kept in line more stringently. If it wasn't for this forum I think I would have either had a nervous breakdown or gotten myself into further debt with a loan or something with a horrible interest rate! You can complain about very bad bailiffs to the council or even to the court they are licensed/registered with I think. Herbie's website has info on this sort of thing. I should probably have a read through it all again myself as I have had so much to think about things seem to have started leaking out of my head!

No sign of him again today by the way.

Thought I should post an update. Nothing has happened! lol! No sign of the Bailiff for 3 weeks now. Not sure what he is up to. It is tempting to start to relax and think maybe he is going to leave us alone as long as we keep up the regular payments. However it is just as likely that he is hoping that is what will happen and we will start to bring any hidden expensive belongings back home.

I have recently found out that I will be getting more student finance than I was expecting this year (final year at uni) and I also may be entitled to money from the Access to Learning fund, so I am going to get together as much of that extra money together as I can along with quidco/Amazon sales etc and try to get Rossendales paid off as quickly as possible. I want them gone and out of my life!!!

I am considering starting a proper diary to keep me motivated so this might be the last post on this particular thread. Thanks so much to everyone who sent me with advice and encouragement, it has really meant so much to me. You guys over here on DFW are fantastic.
  • Good luck with paying them off! I'm glad they never came
