    Have you made the offer of monthly payments in writing to the bailiff complete with a breakdown of income/expenditure so they can see you cannot afford any more?

    I would suggest doing that and sending it by recorded delivery so you can at least show that you tried to arrange payment.

  • I have spoken to Herbie21 in the last week and she has been vary helpful with giving me advice and finding information. One thing I have learnt from everything I have come across is that the Bailiff cannot have you arrested or sent to prison, its just a threat. The worst they can do is send the debt back to the council who can then decide this. I am also currently dealing with council tax through the bailiffs and have come to agreement by speaking to the council recovery department (note not the council tax department, they will say they can do nothing) I told them what i could afford to pay them (which pays off the debt by the next tax year) told them the bailiff wouldn't accept it and wanted a down payment of £500 and what threatening things they had said in front of my 2 yr old son (threatening to take our dog) said I refused to let that particular man into my house again, and that I wanted to pay someone. They then said what I offered would be ok and there was no reason for the bailiff to refuse it and contacted the company on my behalf to arrange it. I did receive a message from the bailiff company requesting an appointment, which I have ignored and I have heard nothing since. I am now paying the bailiff company what i originally offered them. Herbie21 has suggested requesting a breakdown of their charges to check they are not ripping me off there. So in short, speak to the council recovery department, explain everything to them, if you get upset whilst speaking to them all the better as they'll feel more obliged to help especially as you have a young son. Hope this is helpful.

    Thanks guys. I haven't sent the bailiffs (can spell it right now lol) anything in writing yet and we haven't spoken to the council tax peeps yet (will remember it is the recovery department we need to speak to!). Just briefly spoke to OH and he has been on the phone to Herbie21 and he cannot sing her praises enough! She apparently is going to ring him back and do some sort of letter for us. He sounds much happier now having to spoken to her so will see what she has said later on. I feel a bit better now than I did earlier on. I really don't know how I would have coped with this without you guys helping me out. Thanks so much!!!

    Just an update on this. Herbie21 did us a fantastic letter kicking the bailiffs into place! We know our rights now and feel much more confident dealing with it. We have emailed them a copy of the letter and sent a hard copy through the post. The letter includes our offer of monthly payments. Phew, hopefully we will soon be able to put this behind us.

    Worried user, just re-read your post (in a calmer state of mind!) and noticed that the bailiff said he was going to take your dog! What a cheek! If the guy we are dealing with had come round and said he was going to take my dogs I probably would have tried to strangle him with my bare hands! These horrid bailiffs shouldn't be able to say things like this and frighten people half to death. The nice bailiffs definately seem to be in the minority!

    Just an update on this. Got a stroppy email back from Rossendales, basically dismissing everything we said in our letter. What a charming bunch of people they are. OH has emailed Herbie21 for further advice on our next move.

    I really hope you get it sorted out sorry you have to go through so much stress!
    In Jan 2007 I had a debt of £27,896.00 :eek:
    In October 2011 I paid it off and owned £0.00 - Kinda proud of this!:T

  • Hi hows it goin?
    Have you managed to get hold of a debt counsillor who may help you deal with baliffs?

    If the pratt who threatens you turns up again open the door with a video camera in your hand and tape him, tell him it belongs to a neighbour so he can't take it!!

    I don't know if you can report him to the police as its threatening behaviour which is not good for a lady on her own!

    Oh gosh!! I just googled them!!! They are a nasty bunch! Please read all you can about them whilst you have time.
    They have been condemmed time and time again for thier behaviour. This might actually help you in getting through to them and the council!

    Thanks guys I appreciate the replies. Didn't realise that Rossendales were so bad, will google them and have a read through at work this evening. Might be useful info to try and get the debt passed back to the council!

    Am loving the video camera idea too! Don't have a debt councillor but we are consulting with Herbie21 on this forum who is very knowledgable about this stuff. The annoying thing is we can pay them money. We have offered them £150 a month in writing but they aren't accepting it. I want to pay but no one will take my money! How often does that happen???!
