Jaks road to Bankruptcy

My husband and I have been advised to go bankrupt at our CAB appointment this morning.

We asked the CAB what would happen to our bank account and was told that our bank would most probably freeze it when we go bankrupt. We was advised to contact our bank (Nationwide) and asked them about it. We phoned Nationwide's bankruptcy team and asked what would happen to our account. We were told that the bank will freeze the account and was given a fax number to give to our OR so they can give the bank permission to unfreeze the account. The bank are not going to shut our account down - Nationwide are not one of our creditors and we only have a basic cash card account with them with no cheque books and overdraft facility.

We now have to phone our nearest bankruptcy court (30 miles away) and asked for the bankruptcy forms and court fee excemption forms (we only get benfits), we also have to make a appointment to go bankrupt (that date will be as soon as we can save to fees).

The CAB is writing to us with an appoinment so they can help us fill in all the forms.

The CAB is also going to write to all our creditors on our behalf and offer them reduced payments while we are waiting for our bankruptcy date. We were told note to pay those creditors, but to use this money to save towards our bankruptcy fees.

    I finally plugged my homephone back in again this afternoon (after leaving it switched off due to creditors calling) and it didn't take long to get a phone call from a creditor.

    Mercers called me over my Littlewoods CC account, asking for payment, I told them that it was now out of my hands and that the CAB were dealing with the creditors on my behalf. This wasn't good enough for them and the asked me to make a payment tonight - which I refused, they kept going on and on and in the end I told them I am filling for bankruptcy on 3rd September (I don't know if this was the right thing to do or not), they still weren't satisfied and they are going to contact me in 7 days if the CAB paperwork hasn't come through by then.

    I suggest you unplug your phone again :rolleyes:

    Generally not a good idea to tell your creditors of your plans unless you intend squeezing them into getting a deal going about a one off payment, for instance. But as this is not the case here I'd say nowt. They will just bother you even more.

    We receieved our bankruptcy forms through the post this morning. I have contacted our telephone provider and asked them to change our phone number, they will send us our new number within the next 5 days but they are charging us £38-50 to change the number.

    I have decided to wait until after our next CAB meeting (to help us fill in the bankruptcy forms) and ask their advise.

    So far things are quiet, no phone calls and 1 letter from Lloyds tsb reguarding our overdraft.

    good luck jak don;t talk to this clown DCA i mean by that.. they just are bully who intend to squeeze you dry lol ...
    don't let them now u are getting bankrupt , as they may put more pressure on you to pay, just ignore them as i did ...

    CAb were good with us they check our form before i went BR and they give good advise National debtline is good too if you have any question and u can't be bother to wait for the CAB

    and believe me thing will go a lot quieter after you are declared BR.

    Just had a phone call from Lloyds Tsb about my credit card debt. I told them that it is no longer in my hands and that the CAB is now dealing with my creditors on my behalf with payment offers (while we are waiting to go bankrupt). He asked me for payment today and said no, he said that they might not accept the CAB's offer and I said that there was nothing I could do about that. I was so tempted to tell him that I was going bankrupt but I didn't. The last threat I got was that they were gonig to pass the debt on to another department and said "you do that then".

    if i wee you i will answer the phone and put the phone down the side and go do your own things .... like watching telly or play silly gamne with them over the phone this is one of my favourite hours of fun guaranteed (pretend to be someonelse or you keep forgetting and ask them to repeat the same over and over again) lol..
    so they waste their money even more and what else they can do pass onto another DCA ..... it is all threat to make you caugh don't respond to their security question and don't talk to them over the phone they may get you upset too !
