Write to the company and tell them you want a refund under the Sale of Goods Act as the camera is not fit for purpose.

Does that still apply if the company is French?

    Cheers

Did you order the goods from a french address? Their website doesn't give an address (which is illegal). Is there an address on any delivery note etc?

You didn't say how you paid for the goods.

    Hi
I am interested to know if anyone can advise me on claiming against a company for distress I am particlarly interested in the Consumer Rights Article were it refers to stating to a company that you will claim against them for distress caused by their actions.
I applied and paid for a water connection back in February 07 for a mobile home I was moving into in March 2007. I was advised this process would take between four and six weeks. I did not receive a connection until the beginning of July 07 despite 38 sole destyroying phone calls to the company along with two visits to their head office (on the second visit I refused to leave until they progressed my application but was talked into leaving with sincere promises of my complaint being dealt with) I also wrote a letter of complaint which the water company have had for over four weeks without advising me of why we have been treated so poorly.
Spending time with three kids in a mobile home without water for over three months has been a stressful time. I had to bring every drop of water for toilets, washing dishes and general washing every day for over three months with no word of when we would have water. Sounds like I'm having a good moan here but I'm just trying to paint the picture of the distress and frustration of being without water and not knowing when the situation would be resolved.
I feel quite angry at the company and would like some regress. I have considered taking the water company to the small claims for the extra cost of getting water connected relating to my 38 phone calls, two visits and all the water I had to buy and carry. If anyone has any advice on claiming against a company for distress caused or how I would put a cost on this (several million is what my angry head would say )-: , though I am aware the N Ireland small claims has a maximum claim amount of £2000.00) I would really appreciate any advice given. Thanks

PS On a positive note I do have a new found appreciation for water and having it come out of a tap!

It's not going to be easy dealing with a company that isn't UK based. I personally will make a note not to deal this company.

Try writing to them pointing out that under the Sale of Goods Act you require a refund as the camera is not fit for purpose. I can imagine their response to you.

You may have to follow their initial instruction and deal with the manufacturer. This is far from satisfactory as you may get a repair/replacement but you won't get your money back.

You didn't say how you paid for the camera. Was it with a credit card or a debit card carrying the Visa logo? If so this is your best bet for recourse on this one.

Sorry to be a little negative on this one. I hope others will remember your experience if they are thinking of dealing with a company based abroad.

You didn't say but I assume you now have the water working OK.

Try writing to the company pointing out all the problems they have caused and ask them to consider some compensation for your trouble. I don't think that court action is advised in this case.

At best I would suggest you may be lucky to get £100-£200 from them.

    Hi,

I bought a present for my wife from a british store.

When I bought the item I clearly asked the girl whether I could get a refund if she wasn't happy with the item(s) - I was told 'yes, as long as it remains in its original packaging'

When I brought it back today, I was told the store did not do refunds, only credit notices. I explained that I had asked for clarification on this point but was told 'that girl has worked here for two years and would know not to tell you that'.

I insisted I should receive a refund and stated that I felt it was illegal for the retailer to not give me my money back. The girl talking to me just blanked me and told me to contact their head office (her attitude sucked). I was very angry and when leaving stated "I will get my refund", to which she called after me 'no you won't' - she wouldn't give me her name either, saying I wasn't entitled to know it ( I intend to complain about her attitude).

Can someone please tell me whether she is right and I have no right to my money back or whether as I hope, I can get my money back (plus compensation for my distress)

The goods are simply an unwanted present, I do not know if they work or not as they were never unwrapped or removed from their packaging.

I paid by debit card and the total was around £50

    Thanks in advance

If the goods are simply unwanted, as you state, then you are not entitled to a refund.

This doesn't stop you writing to the head office of the retailer to complain about the assistant's attitude.
