st0ne5ish wrote:Hi,
My mum purchased a hairdryer on the Internet; she was not at home when the delivery company called. They posted a note through the letterbox to say it had been left with the neighbour opposite.
Unfortunately the old lady they said they left the hairdryer with has Alzheimer’s and drinking problems. My mum has been to see the old lady twice now and she said she has no recollection of receiving the hairdryer and can't find it. I don’t think she is going to get much joy in trying to get it.
Where does she stand legally? Can she call the company and request they send another hairdryer and make sure they either deliver it when she is in?
Thanks,
Steve
if you ordered the goods to be delivered to your address the retailer hasn't fullfilled his contract until he does so. Neither he nor the carrier has a right to decide to change the delivery address without your approval.
Write to the retailer telling him the goods have not been delivered as ordered and you expect them to arrange a further delivery to the address to gave them.

On Monday, I bought two 15" LCD monitors from Comet but one is faulty and I am going to return it tomorrow. While I don't anticipate any problems in getting a refund or an exchange, I wonder if I am entitled to have my travel costs refunded.
The Comet store is in a out-of-town centre and is about 15-20 minutes drive from my home and this will incur the cost of driving the car there and back. As I am returning faulty goods, I don't feel that I should be out of pocket over this and that I should get something towards my petrol etc.
How do I approach the store about this? I would feel in a stronger position if I knew what I was entitled to, so if anyone has any advice and ideas, I would be most grateful.
Thanks

You could always ask for your expenses as a gesture of goodwill but I don't think you will get them to refund travel costs. Maybe you can ask for a small item as compensation. More importantly, make sure you come away with a replacement monitor.

I just wanted to say a public Thank You to 'Art' and 'ScottishSapper' for the invaluable advice in this thread. If you have been following my posts in this thread, my DeLonghi microwave went kaputt just over a year after I got it from Argos. Anyway, to cut a long story short, I wrote to Argos customer services in January, they had signed the letter but not bothered responding.
I then followed the advice in this thread and opened a small claims case (via http://www.moneyclaim.gov.uk). Within one week of the case being sent to Argos in Milton Keynes they send me a cheque for the full amount without argument :money:
Amazing how much difference a bit of official muscle makes.0 -

Glad to have been of help. Congratulations on your result against Argos. It just goes to show they do know the law - they just try and ignore it until they are forced into action. Did they send you all your costs as well?
Well done!!

to be honest I just claimed for the cost of the microwave (100 quid) plus the 30 quid court costs - so yes if thats what you mean, they sent me a cheque for £130
I didnt really bother claiming any other extra costs - phone call costs amount to a few pence as I only called them once and I wrote to them once so im not too bothered about these few pennies. I was expecting a replacement microwave or maybe argos vouchers, but they just sent me a cheque with makes me even happier :money:
Thanks once again. I dont think I would have bothered with the small claims route if it wasnt for this thread.0 -
