    As you paid by credit card notify your card company that they are equally liable and you expect them to assist in getting a satisfactory outcome.

    Although you are still able to use the cooker you can't use it as intended so you must push for the retailer to deal with this for you. You bought the cooker because it had a timing mechanism and now you can't use it.

    Keep a diary of all the dealings you have with the retailer and any costs involved. This will be useful if you have to put a claim together and will also impress the court.

    Did you buy the cooker from a major High Street store?

  • Hi, Can anyone give me some advice regarding a hoover I bought a couple of months ago please.
    Basically it blew on me the other day, big bang whilst hoovering and died.
    I bought it from argos, and even know the exact date and how i paid for it (cash) but couldnt find the receipt anywhere.
    However I took it back to argos, explained that I bought it on such and such a date, with cash, and the cs looked it up and said, thats correct, they have a record of 2 being sold that month, one on the exact date i said with cash. Ok, great I said, would it be possible to exchange it then? As I had been advised by the manufacturers that it wouldnt be repairable and told to take it back to where I bought it from.
    No, absolutely not, as I cant prove it was purchased by me!!
    I explained that I just had, by telling her exactly when and how I purchased it, but she wouldnt budge.
    Do I really have no rights?

    Don't bother with the store again but go direct to the head office. Write a recorded delivery letter to them. Tell them that if they don't replace the hoover in 7 days you will go to the Small Claims Court.

    I can't find the original post by Woody1 and you haven't given us the details of the company. What company are you trying to track down?

    I ordered a pair of trainers for my oh as a christmas present, date ordered was 4th dec.. i recieved a letter from them about 2 weeks later saying that due to stock running out there would be a small wait on the item and that as soon as they were back in stock they would post the trainers to me. I didnt really think anything was wrong with this as it was right before xmas and with the post etc.. Anyway i still havent recieved the trainers, i have emailed them about 3-4 times since the new year and have recieved the same reply each time, we will look in to your order, we will look in to your order with our suppliers.. in one email i stated if the trainers werent available i wanted a refund, and they just replied as above..

    What i need to know is how do i go about getting my money back, the order was £50, and i paid using my visa electron card. I still have the the receipt email from nochex and the order confirmation when i made the payment from them, oh the company is bestsportsworld.co.uk....

    Do i need to ring trading standards or what, i have no idea!

    You seem to have been very patient with this company.
    Initially, I would send a recorded delivery letter addressed to the managing director telling him that you want a refund and if it isn't received within 7 days you will go to the Small Claims Court.

    I am not too familiar with Nochex but I know it is similar to PayPal. Have you tried to enlist their help in getting your money back?

    Also you don't say which bank issued your Visa card as you might be able to get a refund through them. Which one was it?

    Would it make a difference if my card is only a debit card with Halifax?

    Halifax is part of HBoS and their Visa debit cards carry the same protection for you as a credit card. Phone your card company on Monday and tell them you want them to assist in this matter as they are jointly responsible.
