I wonder if you would get anywhere writing to their head office or whoever stating how many times you have gone to the dealer in an attempt to get the fault repaired, how many hours of work time etc you have lost - and I wonder if anyone else would think it's not unreasonable to ask for a new replacement car if they are unable to repair the fault on the next occasion?0
-
How long ago did you buy it?
You have given them more than enough chances to fix the fault.
If you reject it, they will probably say we don't accept your rejection (but there's no harm in giving them a letter of intention to see if they agreee or not.). Because the car cost £14K it is outside the small claims court, so the cost of the court process could get expensive, especially if you lose.
Because it is a minor fault, the court could decide that it is not serious enough to warrant rejection.
If the rattle is in the roof, can't someone sitting in the back seat locate where exactly the rattle is coming from with their ears.
What work has the garage told you they have done each time? And how is it possible that every time you leave the rattle is gone? Is it an intermittant fault? Are they doing something to actually cure it, but not enough, or are they just lucky it goes away when it is with them?0 -
If the garage is suing they will have to show how much they've lost out - it wont be the full value of the car, it will be the difference between what you bought it for and what the new value is once returned
The car comes with a warranty to resolve faults and if they're not able to do it then the package you were sold is not fit for purpose.
Make sure you have a good record of all the chances you've given the garage to resolve the problems and speak to TS about your rights.matched betting: £879.63

Another anti French car post again then it seems??:rotfl: :rotfl:
Come on guys, it's not that simple, they're all built to a price.
In my opinion it's not the car thats the problem, it's the crappy dealers that are at fault, hence my post.
Go on then, I'm thick skinned:rolleyes:

I like the thanks button, but ,please, an I agree button.
Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)
Always expect the unexpected:eek:and then you won't be dissapointed0 -

yes they are built to a price, but so are other cars that dont have the same poor build quality, its an arguement neither side will win really, there are good and bad in all makes but the french just can seem to make a car that is doesnt rattle or squeek after 5 minutes of use. ive got a focus and the build quality is fantastic compared to other cars in the same price range....work permit granted!0 -
The garage would not be suing, they would be defending themselves, effectively saying we don't have a responsibility to refund the buyer under SOGA. And if they won, they would ask for the plaintiff to pay for costs. If the garage is suing they will have to show how much they've lost out - it wont be the full value of the car, it will be the difference between what you bought it for and what the new value is once returned
A lot would depend on how long he has had the car, and the seriousness of the fault - I would assume. The car comes with a warranty to resolve faults and if they're not able to do it then the package you were sold is not fit for purpose.
In the first instance yes, and then to a solicitor.Make sure you have a good record of all the chances you've given the garage to resolve the problems and speak to TS about your rights.0 -

Meanwhile...
I'd call Peugeot Customer Service telling them that I want to back the car. It may shift them into action, if not. Complain/write to all the usual organisations.Genie

Thanks for all these replies. I picked the car up on this Thursday after 3 days in the garage and the rattle wasn't there. Had the roof down on Thursday evening, then when I drove to work Friday morning, the rattle was back, hence my post here asking for advice. Peugeot were quite convinced they had sorted it this time. We have looked for all the obvious things like loose spare wheel/brace etc. The mechanic has driven out with me and thought he had pinpointed the exact spot - obviously not.
When I called Peugeot yesterday morning, they came and collected my car from my work within 2 hours and have left me a loan car with a full tank of petrol. This time they have asked if it is OK for the aftersales manager to drive it for a few days after they've looked at it, to see if the rattle returns - yes please, I'm beginning to think it's the way I drive !!
My 'dilemma' is that the garage seem to be doing everything they can to sort it, they've always given me a loan car, so I feel that I have to continue being reasonable. When (if) the rattle does go, I shall write to Peugeot, rather than the garage, with my opinion of the vehicle and their workmanship.
And in defence of French cars, my previous two cars were Renaults both of which I had from new for a total of 10 years and no problems whatsoever with either of them. Maybe I should have gone for a Megane CC, but I wanted something little. Oh well, c'est la vie.0 -
Sounds like it could perhaps be something loose/faulty with the roof mechanism? Bit of a coincidence that it started up again after you had had the top down.
I do hope they sort if for you. And it does sound like the dealer is being very helpful, which is good.Genie
