Getting out of a contract through the T&C's?

    Well, I sent them an email via My3 on their website and a recorded delivery letter yesteday confirming my 30 days notice. They just called me to tell me that it wouldn't affect me as I never use all of my inclusive minutes, but told me I could cancel my contract if I wish.

    And I did, it cancels on 22nd September, which is 30 days after the changes are introduced.

    I felt bad doing it as I've found them to be excellent in the two and a half years I've been with them, but the lure of the iPhone was too much and this couldn't have come at better timing for me, less than a week after taking out a new contract with O2.

    If anyone else is looking to do this, this is the letter I emailed/sent. I think an email is enough though if done via My3.

    Dear Sir/Madam

    Mobile Number: ***** ******

    Account Number: **********

    Following the recent changes to your call charges as per your letter dated 5th August 2008, as these changes are of detriment to me I am writing to give you thirty days notice to cancel my contract, as set out in my contract in parts 4, 4.1b(ii) and 10.1(d)


    Please can you confirm as soon as possible that the contract will be cancelled after thirty days. I understand from the contract that no additional charges will be made for cancelling the contract.

    Thank you for your past service.

    They'll call you trying to advise you it won't affect you but they're obviously trying to keep your custom, if you really want to cancel, tell them you still wish to cancel as you're entitled to under the terms of your policy.

    Has to be in writing which is also in their T&C's, doesn't say an email isn't ok though so should be fine.

    is this 'change' in the 3 contract effecting everyone? im in the same boat, i ant an iphone but am only 4months into a 3 contract. im on 300 mix and match. btw, as of yet i haven't been informed about any changes as far as im aware.
  • That looks fair- a lot more fair than Vodafone.

    They have just trebled their minimum call cost for calls outside your allowance, from 5p min per call to 15p min per call

    You have to be out of pocket by more than 10% to be able to cancel the contract.

    i find this thread quite interesting. I am waiting for Orange to make some kind of change to my T&Cs to get out of the contract. Does anyone know of any recent changes?

    I believe if it up's your usage by more than 3% you have a right to cancel.

    I work in the billing side of telecoms, the 'roundup' is a sneaky but VERY profitable move.

    3 don't state this in their T&C's, I believe the other providers do though.

    am on Direct Text 950 and haven't had the letter yet but have sent an email anyway. Desperate to get an iPhone but contract not up until January. Here's hoping
  • I'm just wondering if I can cancel my contract as I'm on a cashback deal with p4u?

    I know I won't get any more cashback but could p4u try and recoup what I've already got?

    My initial instinct is no as I think most of us are well aware of the distance the networks put between themselves and the retailer (phoneboxdirect anyone?) but I'd be grateful for another opinion.
