license revoked HELP!!!!!

Hi I am angry with myself as i know I have done wrong, anyway I have recieved a letter today from the DVLA to revoke my license. I was driving without insurance and basically got caught, I can assure everyone I have insurance now, but the thing is I already have 6 points on my license and am worried that I may lose it. It says in the letter that I can still drive whilst my license is revoked for a maximum of 12 months - what does this mean exactly? If my license is revoked then how can I drive? can someone please explain to me this, as this is the first time this has ever happened to me. I am angry at myself and stressed as i was declared bankrupt at the time and could not afford insurance (thats no excuse I know).

Have you passed your test within the last two years? I have found this:Revocation of the licence has an immediate effect once 6 points are reached. You cannot drive alone without retaking the driving test so you will have to apply for a provisional licence and re–sit and pass all parts of the driving test again.
I don't think you wold be allowed to drive alone as you would be like a learner again.:j Almost 2 stones gone! :j

No I passed my test in 1994 and have had a clean license up until now, i went through some personal issues which led to my bankrputcy where i lost my home my business eveything, and now i am worried i may lose my license.
Any suggestions?0 -
I take it you accepted the charge and was awarded points for the insurance? In which case, you'd have an automatic ban under totting up. You can't drive without a valid licence - end of. 12 points is a ban under totting up although you may be able to plead for your licence if you could show it meant extreme hardship for others such as you being the only earner in your family and doing a driving job where losing the job from loss of your licence would cause unnecessary hardship for the family.
But in short, I'd get used to using the bus for 6 months if I were you - maybe longer as insurance will be horrific with an INS code on your licence.
Phone the DVLA to clarify. And I'd not drive until you have.0 -
Don't drive if you are disqualified.
The punishment is pretty heavy, I have the guidelines for judges and the starting point is 12 weeks custody up to 26 weeks
and they can lengthen the ban up to 12-18 on top.
No Insurance
Band C fine
6-8 points and they can give a 12 month disqualification.
Either way you were going to be disqualified as you have the existing 6 points under the totting up system they just went direct and disqualified you.
Items than can reduce the punishment
prove you were not responsible for the insurance cover
genuine misunderstanding
recent failure to renew or failure to transfer vehicle details where insurance was in existence
Vehicle not being driven.
Unfortunately none of these are applicable for you, not being able to afford insurance isn't a viable reason as far as the courts are concerned, running a car is not a cheap exercises.
Unfortunate for you one of the factors that could go against you is if they can prove that you had been driving uninsured for an extended period of time it could get to the worse end of the punishment scale.
Infact the recommendation is a 6-12 month disqualification if sustained use evidence is available. if they think it is a one off offence 7 point or 2 month disqualification.
Regarding the revoking of your licence confusion I would contactt he DVLA and get them to confirm what they mean exactly.0 -

Having your licence revoked is different to a driving ban/disqualification.
Did you receive a fine + points and then not surrender (send it off) your licence to have the points added on to it?0 -
i was thinking the same has road hog it's not a driving ban/disqualification it's worse ,no licence at all ,you need to apply for a new one and they may or may not give you one
i think there saying send us your licence now or lose it for good (back to a provisinal)there or their,one day i might us the right one ,until then tuff0 -
They have revoked the licence because for some reason they have been informed you are disqualified, but haven't had the licence handed in.
The letter which says you can carry on driving for 12 months will then say something like:provided that you are not prevented from holding or obtaining a licence by a Court
If you know of no reason why your licence has been revoked (driving without insurance attracts 6 -8 points) you should appeal the revocation.0 -

It is true - but they may have been misinformed as to the reason, which is why they are saying he can continue to drive for another 12 months if there is no reason he knows of why he shouldn't!
Why argue? Just trying to help. The op asked how can he be allowed to continue driving (as his letter says), and I have tried to explain why.0 -

From the above, I assume the 6 points you quoted in the earlier post referred to the penalties imposed by the court?
In which case, it is likely you have failed to submit your licence to have the penalty points annotated....and should do so immediately.
were you actually in court for the no insurance offence to be dealt with?
If so, then any ban would have been issued at that point in time....active from that point in time ...
But, it seems you weren't banned from driving?
Revocation of a full licence will occur to a new driver who incurs 6 or more penalty points within the first 2 years of holding a full licence. It is not a punishment imposed by a court, but a regulation enforced by DVLA.
It means, one's licence reverts back to provisional status...one can continue drivng, but under supervision....best plan is to book a new test asap.
[this begs the question as to whether a new driver, intent on commiting an offence, should really ensure they are hung for a sheep as a lamb ? The idea being, to actually go for a mandatory driving ban...which replaces the penalty points...book a few weeks holiday, and return having retained one's full licence? Of course, the magistrates courts have recieved instructions not to issue a ban specifically for this purpose......]
Have the DVLA made a clerical error, in assuming you were a new driver?
Best contact them and find out????No, I don't think all other drivers are idiots......but some are determined to change my mind.......0
