  • Well, too good to be true. I get another letter today, asking for my Bank Statements dating back to 2004 and contact details for the Solicitor used when I put OH on the deeds of the property.

    I am getting really cheesed off tbh, I have had two lengthy phone calls off him since going BR on 3 July, both calls asking for completely different things, for which I provided everything he asked for. I asked him during the last phone call why there was a problem, and he said, not to worry, he just needed a bit more stuff...which I sent him. That was 7 weeks ago, and I now get a letter asking me for more stuff. I have no idea what he is actually getting at and what the problem is. I just thought it was all done and dusted, I am such a straightforward case...I thought......am not working, we are selling the house...that's it! But for it to drag on this long, and still not know what they are unhappy about...well, it doesn't help with trying to move on and put it all behind you.

    I have been sent a pre-paid sticker thingy but I am sending a huge pile of Bank Statements, shouldn't I send them at least recorded or something? I have spent a fair bit already on sending him stuff.

    Is it too far to hand deliver them? You could say you don't have them, these are things the OR could actually get for himself. Many people don't keep statements (although I had every single bank statement and credit card statement for at least the past 6 years - I was glad to get rid of all that clutter!)

    Agree FYP, I have no statements whatsoever back more than probably 9 months, I check them, and mum shreds them. When I went into the IVA they got all the wanted from the banks, or should I say they did not bother to which I now think was the case. They had me hook line and sinker IVA passed so left it at that I think. They wanted wage slips for 3 months.

    So sorry to hear all this Summer you were here when I was in June and I remember laughing with you that we were doing it at the same time, mine took til this Wednesday again down to IVA people as I needed the failure certifiacte and they said failed in June but did not officially fail it til September.

    I wonder why this OR is going into so much detail, I would have thought you were a pretty standard case. You were working when re mortgaged if not I could see why the investigations.

    BRO, as you have said Summer, who cares, like you they slap one on me I dont really give a monkeys uncle.

    I hope you get closure to this soon and can move on which is what you are trying to do.

    Hi Summer, Ive not been on for a few days, but I am reading your post with interest as your situation does sound so so similar to mine. A lot of my debt was paying off Hubbies at the beginning, then he consolidated and then that didnt work so we continued spending on the CC's (In my name) after I gave up work.
    it all came about soo quickly tht we realised we couldnt pay everything anymore.. Literally September we were like OH and Now I am BR.. he is not ..
    I hope you do get a good outcome as like I said the situation from reading sounds similar.

    Thanks for all the replies, guys. I guess I am just wondering why, 4 months ago, he didn't ask me for the past 4 years' Bank statements which he knew I had. I suppose cos he wanted me to do all the work. I just have no idea what they are still investigating. I provided proof that we applied for the remortgage 3 months before I was signed off work with stress. And now 7 weeks on, they want the statements which will show them exactly what I have told them and they also want the Solicitors' details that dealt with me putting OH on the deeds! Have no idea what that has to do with the bankruptcy! It was 2 years ago.....I could understand if I put his name on the deeds a month before going BR or something...but stumped....again. The flat is up for sale, there will be no equity, and OR knows this, so its not like OH is going to benefit at all. I am completely stumped. OH is going to take the stuff round by hand as I am fed up with keep forking out for sending them stuff Special Delivery. But I bet I get another letter in about a month's time asking me what the remortgage monies went on.......which I put in the last letter to them......:rolleyes:

  • Well I bit the bullet and rang the OR, well the latest one that sent me the last letter.

    I asked him that I was confused it was 4 months' on and still no outcome. He said it had been passed onto him as it was not a straightforward case. Talk about get it wrong, I thought I was such a straightforward case!

    He said he needs to look at the loans I paid off to OH and the fact I put him on the deeds, as it could be seen as a 'gift' and favouring creditors over him. I told him that I put OH on the deeds over 2 years ago and that I had no idea then I would be going bankrupt. I put him on the deeds because he had been contributing to the mortgage and I wanted him to feel that it was his home, as well as mine. He said he needs to look at the value of the flat back then, the fact it has no equity now, has no bearing. Luckily, it was worth back then, roughly what its on the market now for due to the drastic drop in prices.

    I asked him what would happen if he deemed me as favouring OH over creditors, and he said it would be BRO, which could be 2-15 years. I said I understood this.

    Blimey, I feel like I am waiting for a prison sentence....lol Have to laugh......

    I have got the bank statements and a copy of the Transfer of Equity together and OH is dropping them off by hand in the morning.

    I hope for a quick outcome now, its been such a long exhausting process already, I just want it over and done with now.

  • Hey guys - just an update from me. Still haven't heard anything...went BR on 3 July, have had 2 different ORs dealing with me, they have both mentioned a BRO...but didn't say it was definite...but obviously still can't come to a decision. I get that they are probably busy but I would have thought that 3 July, I must have been near the top of that pile at some point....oh well....looks like I won't hear anything til after Christmas...is this a record? :rolleyes::D

    I can't believe how long its taking them, they have had everything they needed off me ages ago, they didn't have to get anything themselves, I provided everything but I'm obviously just a number on a file...and not a real person, needing closure. But I have decided not to get stressed about it, even though they have not made it easy. Hope you all have a peaceful Christmas and don't spend too much!! ;)

    Try and forget about it until/if you hear anything.

    They take a long time to put a case together, have to get copy statements from banks/credit card companies (some of these never respond - and cases then get abandoned due to lack of evidence), report is then drafted and send to authorisations team to check over, edits suggested, etc. Just think of it as no news is good news.

    If it was me, I would take a step back and say to the OR, I have given you all I have got..........do your worst! In not so many words of course! However you have done your best, so you cannot do any more. In my opinion a BRO is the most ridiculous piece of legalisation invented. It means nothing, unless you want to be a MP/Insolvenacy practioner/declare that you are BR if you want credit over £500 ( wouldnt get credit as you as BR anyway ) or be a director. I have my OR interview on Tues and I couldnt care less if they give me a BRO. Think it must make the OR feel good tho. Surely the OR can see that a BRO is just a limp slap on the wrist. Rant over, feel better for that. Good luck Summer, but stand your ground.
