In England you can now register small claims (court) online.

I think more people should start doing this. If it starts to clog up the courts HMG will start putting pressure on ebay to get its act together.

I'm in Scotland so I'm stuffed.

Also better paying by PayPal although not a lot better. At least you have a chance then.

But ebay are sooooooo slow at sorting things out.

i face the exact same problem, but i paid with a cheque, and it has already been cashed....

is there anything i can do, or am i in the same situation as "tab" and their postal orders?

The only thing I've seen suggested elsewhere but with no indication that it works..is to notify your bank that the cheque was issued and no goods received and see if the bank can recall it. The cheque isn't covered by cheque card protection so there is a small chance the bank can do something if all this happened recently.

As you sent postal orders you will have the sellers address. You could try sending an official looking letter demanding your money back within a set period of time or you will consider the small claims court. However, it is almost certainly not worth a claim for £48 but the seller might not realise that.

Postal orders are unfortunately not much good protection wise , but out of interest what was the sellers feedback like before you bid? That might give a clue as to whether he was a scammer or whether there is some other problem.

It looks like that seller got closed down for selling links, her feedback is poor and the negatives all seem to suggest that buyers felt conned even though she made it clear in the auctions she was only selling links.

With hindsight never ever bid on a seller with barely 90% positive feedback, if she was happy to sell dodgy links she obviously cared very little about customer satisfaction. Also, even some of his positive feedbacks mentioned the seller was a problem.

I really don't know where to suggest you go from here, it might give you some satisfaction to send a letter (keep it polite though!) explaining that you are unhappy that you have been ripped off. I suppose as a last resort, if you are cross enough, you might even want to find out which is the local newspaper for your seller, most large places have a local rag, and see whether they would like to do a story? Wonderful page filler of a story 'local con artist banned from ebay'.. ;D you never know, it might be printed!

I've just been ripped off for £87.. contacted my bank and you cannot claim the chq back once its been cashed unfortunately!

Any suggestions on what I can do, eBay will just tell me to take it up with the seller, but seeing as he now wont reply to my emails how can I do that?

Edit: - How can I find out the sellers phone number, the eBay help section mentions phoning them to resolve a dispute, but I can't see how to find it?

To get your sellers details go into ebay and click on the 'buy' tab at the top. When that page opens look a little way down the page where it says 'search' and click on advanced search.

On the left hand margin there is the option to 'find contact information', just enter user id and item number and in a few minutes the contact details will be sent to you.

    Thanks Soo,

Its a mobile number and all I'm getting is a voicemail service, haven't left a message as yet.

I have written a letter to his home address as he won't repsond to emails. This was friendly-ish, but I ended it stating that if he didn't respond to my letter or emails that he left me no other alternative than having to report him to eBay and take steps to try and recover my money.

    Fingers crossed x

    Well done.

    Think you are lucky.
  • What I suggest you do is

    Option 1:-

create another username on ebay and bid (right at the last minute, a stupid price to make sure you win it) on everything the seller has got advertised for sale. Make it impossible for them to trade. You may not get your money back but the seller will be charged for the advertising and the selling of the item anyway. If you can't have the money niether can He/She. 1-1

    Option 2:-

Find out what items the seller has bought and sold, if there is an interest in mobile phones for instance, email them and say you have 2 or 3 for sale (covering the cost you have lost) at an amazing price and see if they would like to do a deal. If the deal is a good one it won't matter to these clowns whether or not it is done outside ebay!! Get them to send you a cheque or postal order and keep it!!! 2-1

    Option 3:-

Email the seller and tell them that you follow a certain football team and you travel to all away matches on the train with 'a few friends' and the next time you are in there area you can nip round and collect your money. Nobody wants anybody turning up on their doorstep, especially with a few friends in tow. 3-1

    Option 4:-

Tell the seller that you have been a good boy this week and you have been given weekend release and the your cell mate used to live in the area and has given you directions. I will nip round to yours next saturday morning, if you could make sure you're in,
it would be much appreciated. 4-1
