    That's because I don't use them every day, but I need help everytime I use them.
    Very few texts are unavailable on tape, or will not work with an electronic text to voice device. These texts are so limited that you would not need this assistance on a daily, or even weekly basis, and therefore it would not be a reason for even lower rate, let alone middle rate care.

    I've yet to come across electronic versions of any texts (magazines & newspapers) I read, therefore, I need help reading daily. (or whenever my parents buy the papers)

    im not tying to attack you, just trying to help. lots of people find it difficult to read maps, i know id struggle, especially if i had to drive at the same time!

    I receive the middle rate and my carer is with me 35hrs per week

    You state that your condition has changed since your award on 14th April 2008.

    To open an award you need to show that you have had a deteriation in your conditions for 3 months.

    We are now on 27th July 08 and this seems a very quick response to your letter, which shouldn't have really went in untill the 14th July 08. (13days)

    If you put the letter in before the 3 months was up from being awarded it on 14th April 08 then there right to refuse you as the 3 months would have taking you back to around the time the decision was made and you would have had 1 month to appeal.

    It's for constant care OR supervision and can be for day OR night.

    If you require it during the day AND night then your looking at High Rate Care.

    I think the wording is more along the lines of "majority of the day"
    But I think this thread proves a point that DLA is NOT one size fits all benefit and thats half the problem and why so many claims end up going to appeal.
  • Claimants' understanding of the purpose of DLA and its qualifying conditions

    New DWP research

    The DWP has published new research that examines the extent to which claimants applying for disability living allowance understand the purpose of the benefit and the qualifying conditions.
    With 52% of claims disallowed, the aim of the research, 'Disability Living Allowance: disallowed claims', was to explore the reasons why there are so many applications from people who do not qualify for the benefit. The report's findings, the DWP says, will be used to design strategies for improving the targeting and efficiency of the claims process.
    Amongst the main findings of the report are that -
    • there was a low level of knowledge about DLA and widespread lack of understanding about the entitlement criteria;
    • applicants frequently confused DLA with out-of-work benefits and made the assumption that it was a 'substitute' for the ability to work;
    • professional advice and support for a claim from a health, welfare or benefits professional was often decisive in the decision to apply, even in cases where the claimant themselves had serious doubts about their eligibility; and
    • misinformation about DLA and the structure of the application process are both a source of the problems which lead to claims being disallowed.
    Amongst the report's suggestions for reducing the number of disallowed DLA claims are -
    • changing the name of the benefit so that it better reflects its intended purposes and the criteria under which entitlement is assessed;
    • bringing the provision of application forms entirely in-house, and dealing with third-party organisations only in relation to specific cases; and
    • strengthening existing messages in printed material about eligibility and the appropriateness of claims by highlighting and repeating key information about the nature of the benefit and who should be applying for it.
    Take a Look here at the papers, hope it helps those who need it and don't want it because the lazy !!!!!! across the road is on it.
