Hi CCA letter below - nicked from a previous post. Cannot get rid of the red.
Send it registered post, with a £1 postal order and do not sign it, just print your name.
This effectively places the debt in dispute. Clarity then have 12 working days =2 before they are in default.
After another 30 working days, you can tell them to get lost, although if they ever come up with the documentation, you will have to pay.

I do not acknowledge ANY debt to your company. I require you to supply the following documentation before I will correspond further on this matter.
1. You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account. I enclose £1 in payment of the statutory fee.
2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.
3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.
Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities, therefore if I do not receive evidence that I owe your company any monies by 20 December 2007, I will have no hesitation in passing your details to the Office of Fair Trading.
As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued.
Take note at this stage, that any legal action you may contemplate will be both vigorously defended and contested.
Regarding your threat that a Doorstep Collector will call the owner of this property is denying you or anybody working on your behalf access onto their estate or grounds in relation to this disputed debt, should you or any agent acting for you attempt to gain access to the estate or its grounds, then you will be ignoring your denial of access and the owner of (enter address) will take legal steps to sue both you and or your agents for trespass, please also note that having a letterbox on the property gives you or anyone working on your behalf neither implied nor expressed rights to enter the properties boundaries, again any instances of trespass WILL lead the property owner to sue both yourselves or any agents working on your behalf.

As far as I was aware theyre not a DCA they are the original loan provider who changed their business name. I had a WARNING yellow postcard from their so called DCA "Allied International Credit (UK) Limited", based in Glasgow but settled the outstanding amount and informed them before the account was taken over by Allied.
A few months ago I received a letter from Barclays Partner Finance informing me that they were formerly Clydesdale Financial Services and I had arrears with them.
I refused to pay as I had never heared of either company. I then had a yellow postcard from a company calling themselves Allied International Credit (UK) Limited, based in Glasgow informing me that BPF had informed them I needed to send full payment immediately. They didnt indicate what would happen if I didnt but told me to act immediately! I also continued to receive phonecalls from BPF to say I owed them money but on trying to find out who to they conveiniently kept cutting me off!? So obviously my suspicions started being allerted, even though I was trying to justify maybe it was their 'auto dial systems' at fault.
Being in enough debt and not thinking straight I have now cleared the arrears (as they threatend me with further action) and set up a new Direct Debit (they said they would remove the admin charges if I did this so the arrears would be reduced) so I did.
I was advised by Currys to phone up BPF and ask them to send me a copy of the original agreement which I signed. So as soon as I got home this afternoon I rang up Barclays Partner Finance and asked them where I took out the loan to which they answered a Currys store!
I then explained I had checked with that store and they dont deal with BPF! I then requested they send me a copy of the paperwork of my original signed agreement to me by 1st class post stating I needed to get this sorted asap! The advisor appologiesed and said it would only be sent 2nd class!
As I said its been 2 weeks and still I havent received anything, thats pushing it a bit even for 2nd class post these days!
I will send an official letter and they can keep chasing me and charging me for another 2 weeks.

I have been a victim of Clydesdale Finances dodgy practices. I won't go into details because it could take hours, and would be very boring.
What I would like to know is how do I go about claiming charges back off them?0 -
I have now been waiting over a month for the information. I last spoke to BPF by telephone where they agreed to send out a letter to say the account was finaly settled and a copy of the original agreement.
Well surprise surprise I have never received either :mad:, I have checked with a previous address they had on file for me over 8 years ago (I have moved 3 times since then, which should they be genuine company I have dealt with would have known this as I contact everyone to let them know and I wouldnt have missed anyone out by mistake or otherwise as I keep records of companies and details of account numbers etc).
Can someone please tell me what I do next as my local Currys store has kindly been in touch to see how I am getting on as they offered to help prove it wasnt connected to a purchase there at one point.
Who do I contact to make a complaint against Barclays Partner Finance lack of customer care?

Start by making a formal complaint to BPF main office.
Copy that to the OFT and to the trading Standard's office closest to their main office.
if they are members of the CCa add them as well.
If you do not get a satisfactory outcome, then make formal complaints to all three and the FO.

Hello and thanks everyone for the helpful advise so far.
I have 1 question though I haven't sent any letter just made a verbal request several times in the past year and they stated they would send the copy of original contract I apparantly signed out in post. One occasion they confirmed it had been sent but to wrong address (previous address I used 8 years ago when I have moved 3 times since then, and as I explained above if they were one of my creditors then I would have told them, checked at old address and nothing ever came for me) Secondly never received a letter from BPF stating that account now settled which seems odd as all other debts I ever had have done this to keep a record.
The letter earlier in this post was for a DCA which BPA is not, apparantly Barclays Partner Finance were Clydesdale Financial Services who alegedly gave me a purchase loan for something at Currys electrical store, however Currys have helpfully told me they have never used let alone heared of either BPF or Clydesdale FS and double checked with head office who said they hadnt either and always used HFC for past 20 odd years and I also have credit with HFC for other purchases at Currys anyway so I know this is true. Currys have also done a search on their computer and cannot trace a matching debt, at which they agreed to help prove its not connected with Currys if I can get hold of a copy of the original agreement apparantly signed by me!
I dont see why I should have to send out a letter to request the info in writing, they stated they recorded the telephone calls stating they sending details out to me so surely I can go ahead now and make an official complaint? Otherwise its wasting more time getting nowhere?

How are you getting on with these people? I’m interested to know as my daughter and I are just on the first steps of experiencing a problem with Barclays Partner Finance.
She had a Buy Now Pay Later deal (12 months) with Jessops, where no mention was made of an early settlement charge in the original paperwork, and even though we’ve settled the loan amount, they are now claiming a £29 charge is still owed.
Even with the famous Barclays name attached, they are beginning to sound like a bunch of crooks.
