  • Hi, Dont know if this is relevent or if i can get anything from it but i have been waiting almost 3 years for my bank charges to be soreted. I am already on hold and eagerly waiting in the queue but after seeing this financial hardship thing.. If i am in debt up to my eyeballs and currently signing on with JSA (Job Seekers Allowance) Am i in my right to apply for financial hardship as it is almost impossible for me to live off the money i get and pay bills to keep them happy too.. :confused:

    Any help in this would be fantastic.Thanks:)

    Do you have priority debt arrears(mortgage or rent, council tax, utilities)?
    DO you have credit card, store card or catalogue accounts arrears?

  • Well, I live with parents but they are both on benefits! i have debts but not mortgage or rent. I pay my parents X amount from my money when i get it so thats why i was just enquiring what the score is.
  • Firstly, I would ask lloyds for a list of charges or statements on the account dating back to July 2001. Once collections call you, by the way, tell them that you are disputing the amount owed with Lloyds and you are asking for further information and for them to put a hold on collection activities on your account for 2 weeks and you'll update them then(main thing we need to get from them is more time and do not pay them a penny). Furthermore, if you receive benefits or any monies to the account then please open a basic account with a bank not connected to Lloyds so not Halifax or bank of scotland.

    first at all many thanks for your help...do you mean i should reclaim my charges through hardship? if yes what kind of hardship story could be successful? by the way i dont receive any benefit!

    No you shouldn't accept the payment if they are repaying your credit card. You should be telling them that the credit card charges claim is separate to the bank charges on the current account claim. If they repay the charges from the financial hardship to the credit card then I would probably start reclaiming the charges on the credit card. Does that make sense? You are at least going to make £350.00 plus interest so I think the offer is not good enough.
    Interesting offer none the less. Have you requested the statements on the Coop card?

    I am at the start of the ladder and about to apply to Barclays for Financial Hardship. I go overdrawn because of there charges EVERY month as my dd bounce back.
    I had to cut to part time work due to health in pregnancy in Feb this year, I have been off sick since June due to this and am now on Maternity leave basic pay. I have 2, very soon to be 3 kids. Hubby is not working, he was the house husband and now cannot find work. We do get Tax credits, max rebate on Rent and CT but still dont break even as I got into debt with rent and CT.

    From my budget I would say we fall about £300 short every month. I have £500 CT debt, £500/£550 Rent to LA debt, £400 Water rates debt too along with lots of CC and catalogue County Court letters coming in. I have written to my Water company already about the hardship and sent back our financial details in hope they can help.

    Would I be likely to get anywhere in applying for hardship? Should I write to Barclays with my financial statement or in and out goings, copies of debts to Council and rent etc? Do I need to include anything else? :confused:

    Hang on, let's start with the Catalogues ones and the County Court letters. Who are they coming in from?
    Can I ask you start a new thread on the forum so that it is separate from this big one.
    When you click on the reclaims part of the forums at the top of all the various threads it says "new thread" click that one and then give yourself a title ie "evie82 fights back" and then start with these details cos I think we have to reclaim the charges to prevent litigation and reduce any arrears and debts.

  • Mojo, you are not going to like my post and it is not meant with any malice whatsoever. My personal opinion is that it is unlikely they will agree to a refund of charges since the priority creditors are being repaid.
    One question though, did the Co-op give a reason why they did not think you were in financial hardship?
    However, it does bring up another question, are there non priority debts with charges that can be reclaimed or even missold PPI?

    Yes they dont feel that I am in hardship as I havnt gone over the £200 overdraft limit. This is because I have cancelled DDs on their suggestion to avoid adding to debt. I now pay everything - well the priority everything with cash. I'm around 1200 short a month now. They say I should go over the £200 then I would be eligible for hardship. In other words take out more debt with us before we decide what we will do. I thought I'd been irresponsible enough but apparantly not.

    Ive looked at the non priority and yes I have ppi on around 9 loans/cards that I have. Thats another story though. Tried to get some back at the beginning of the year when I started to get in trouble. Used some of the letters from the site but no go. Then in desperation took out some claims with a well known company who need paying up front. Was told that everything would be sorted by xmas by the rep who was my financial advisor. What a joke nothing has happened in almost 10 months apart from the rep pocketing £2800 from my dad. I have complained but the advisor clearly lied when the investegaion was underway and told me he never gave timescales. He also advised that I take out an IVA when I told him I was struggling and when I eventually contacted the solicitor he had passed my claims onto they told me that I would have broken the agreement had I done this and they would charge me for that!!
    In hindsight I see that this advisor - who may I add is a fine upstanding member of his community and church - just took me for a mug and wanted the referral fee for anything at all I would sign up to conflicting or not.
    If I ever do get out of this mess I will certainly never ever take on debt again. All the stress has lead me to be clinically depressed and sometimes I cant see a way out. All self inflicted I know. Really dont have the energy to take anything any further, thanks for your advice anyway.
