    i was discharged on 02/10/08 and fired off 11 letters by recorded delivery 2day, cost me £11.88 - £1.08 to send a recorded letter, got to be a bargain for a tracked letter..
  • I was bankrupt May 2003 and discharged April 2005, was looking forward to a clean file in June next year as would like to get a mortgage. Have just got copies of Equifax and Experian files. All looks OK except for 1 entry by Black Horse. In Experian report it shows account settled 08/12/03 and another as partial settlement 04/05 - no default recorded. This account was included in the bankruptcy so I believe that a default should be recorded by Experian on the date of bankruptcy. The Equifax report does show a default date 11/03 with a partial settlement on 08/12/03. I know that this has to be changed as ICO states default date must be no later than bankruptcy date. However will this stay on file for 6 years after the (amended) default date or the date of partial settlement? If the later will "partial settlement" as opposed to "settled" have an effect on applications for credit in the future?
    Do Experian have to record this account as a default? If so I will request it to be changed and have a date same as my bankruptcy. How can they show it settled 08/12/03 and then partial setlement 04/05 ? Which date is used to keep this on the file for 6 years?
    Sorry for all the queries but in present climate getting a mortgage will not be easy with any sort of bad history.

    whilst still trawling through my credit reference file for errors (cant help thinking if i took this much care investigating my finances 5 years ago i would never have gone bankrupt) i have noticed that i have 4 creditors listed in my bankruptcy for pretty sizeable sums they are not listed anywhere in my reference files ???
    has anyone else discovered this ? £19,000 of debt dissapeared :rolleyes:
    some of my creditors have listed as default on the date of bankruptcy others are well after bankruptcy - this despite me sending recorded letters to them informing them of my forthcoming doom.... yet they still list me as default after the banruptcy....
    now will they be so laxidazy in tidying up my account as they were previously !!

    i am glad someone posted a note to me about martins tip for getting your reference files for free - feels great to be getting one over the "big brother" brigade !
    equifax were quite snotty with my application - i had to speak to someone on phone cos apparently my card failed (nothing to do with it due to expire at the end of the month !!)
    then the lady on the phone said you are joining for the free months trial - oh yes i am and i wont be paying the £69.99 annual fee.....:rotfl:
    this site gets better by the day. the more time you spend on it the more you save (probably cos you are too busy reading posts to remember to do the shopping that your wife asked you to do!!!!!!) whoops...
  • Hi everyone, its great to find a site where we all help each other through our post bankruptcy problems.

    Okay, so here is my story -

    I declared bankrupt 27 July 2007 and was discharged 27 July 2008. I had 5 accounts that were defaulted and I have got them all satisfied apart the one from Welcome Finance. Just sent them a follow up letter regards 'according to the DATA PROTECTION ACT, information they hold about me on the CRF's is incorrect. Hopefully this will be rectified soon thanks to info I have found on this thread.

    Now, onto my problem -

    I have a company called Bibby Financial who have a CCJ against me. This was placed in May 2007 (two months before my bankruptcy). I included this debt in my bankruptcy order. Now, I am trying to get get this debt satisfied, is this possible?

    I have spoken to Bibby Financial a few times and they said it will be sorted but I've got a feeling they won't sort it out. Are there any other ways around it.

    I went to the county court with my bankruptcy order showing them that the debt was placed in the order. I also showed them my discharge certificate to prove I had been discharged. I then requested a certificate of satisfaction and they said no. They said I hadn't actually paid the debt off.

    My main aim is to have a clean credit file (apart from the satisfied bankruptcy). Having a CCJ is gonna be a pain in the !!! but having it satisfied on my CRF's would be much better!!

    Any views or comments would be very grateful.

    Sound like you have just sent them a standard letter say "I'm going BR" ? :j .

    You need to send them a copy of the letter that is on another thread, say "Change my dates on file etc etc" I'll find the link later. I have used the letter and everything has been amended apart for AA Personal Finance, who are being a pain.

    I see no reason why not. Firstly send them a copy of the letter from the other thread, send it recorded delivery. Do not phone them. The debt was before you went BR and was included in your BR's. Check with your OR that it was included, do not assume.

    Has anybody else had any problems with companies agreeing to amend their details and send you a letter to say they are going to but they don't actually do it even though they have had more than a month to do what they say?

    Oh well it looks like im going to be taking my complaints to the next stage then with the ICO :mad:

    Hi - a few companies who I had defaults with amended their records immediately and subsequently the CRF's were marked as satisfied with 48 hours which made me very happy.

    Some companies do take longer though as they have to be passed on to different internal departments. Also, some companies only send updates to credit reference companies once a month.

    I would suggest calling them for updates and keep hassling them. It worked for me!

    It was definitely included in my bankruptcy order. I was told by the court as I couldn't get a certificate of satisfaction as the debt had not been paid off. I believe I am going to get the same news from the CCJ claimant also. I think the only way I can make this better is to put a notice of coorection next to my CCJ on my credit file. Unless by law under the Data Protection Act, they have to make the debt as satisfied.
