I was just wondering, is there anything we could do, compensation wise? I would not or never have broken the law in my life till last year, when you see your partner in that much pain that she cant even get out of bed on her own any more or in and out of the bath what are you meant to do? I had savings of just over £3000 but they did not last long and when they were gone that was it, so what would of you done? just let her slowly get worse and worse or put her in the car with no tax or insurance and get her to hospital for treatment, saying that it's only down the road, 36 miles away, and saying that I nearest shop was only 6 miles away, there was nothing more I could do.

Personally I'd have asked for the doctor to come round or, if really urgent, called out an ambulance. (I care for a husband with a chronic, life threatening condition and this is actually what I do, rather than what I might do.)I think that I'd also have sold the car to raise money as I wouldn't be able to drive it without tax and insurance. Perhaps that's just me.

To clarify (as it's over a long period):

Your wife was signed off sick in January 2007. Is she still employed, or did she resign, or was she sacked, at that point?

She claimed IB and DLA, but the DLA was turned down and the IB one refused because her employer had not paid her contributions.

She wouldn't have got IS at that time because you were still working until Easter time. But you put in a joint claim once you left work, which was turned down because you left voluntarily?

When did you reapply for IS and what was the reason given for it being refused?

Meanwhile you were renting privately and paying no rent, [or council tax] and hence you were evicted in January 2008 and you still owe this money to the private landlord? Have you been getting HB and CTB since your ds was born, or have you not paid any rent, or council tax to either landlord since April last year?

Have you applied for HB or CTC? If yes and it was turned down, what was the reason given?

Since January, you've been getting ctc and cb for your ds. Have you received any IS or JSA for you and your OH though?

That's a lot of question I know but it will help people answer if they are clear about your position.

The priorities as I see them are finding if they are going to back pay the IB as that will be a big help, and ensuring you are claiming everything you are entitled to at the moment.

It may be worth reapplying for the DLA at this point. Once you know where you are income wise, you can start to sort out a debt repayment plan.

Do contact the CCCS, or other one listed on this site (don't pay for this service as you don't need to!) and start making some effort to contact your creditors asap. They will do that for you, or at least advise you what to say.

If you are awaiting a decision about the insurance issues then you need to get legal advice, I'd have thought, and you won't need to pay for that. Sorry but there is no excuse for breaking the law - what if you put another family out of work and in the same boat through you driving without insurance? I sympathise with your general position but not with those choices you made. Hopefully it is all dealt with now though and not still hanging over you?

    Bestpud you're a saint!:A

I really hope that you haven't put all that work in for a windup merchant!

windup merchant - sorry i am not, this is a real situation that we have been put in, I have been going through the paper work for the past 4 hrs trying to sort it out and am continuing to do so, as I am aware I should not of been driving, I know this as a few of my family are coppers and they come down very hard on this, but what choice do I have when my partner has to go for treatment every week, are local hospital got closed over a year ago and swindon is the nearest that offers this treatment on the shortest waiting list, I sold my partners car to cover costs and did not put any other family in the same boat as our self's, as before I have had car insurance and my partner for well over 11 years each, as for my partner having a baby 11 months later is neither hear nor there, yes she had to have a cesarean and they cut a main artery, she lost 4 pints of blood over the course of a 2 hr cesarean that was meant to take just 30 mins. just to add to our misery this got infected and she spent the first few weeks still in hospital instead of being at home with her son and partner, answered most of you critics now?

People are not generally being critical but just trying to understand your story. Bestpud's put a lot of work into trying to disentangle the situation so that people can offer advice; perhaps you could read her post and see if she's got things straight? If you give people the other information she's asked for then you'll get more and better advice but you seem to keep giving lots of unnecessary personal information rather than giving dates and details of benefits claimed and the result of these claims.

You can't really expect people to be sympathetic to your driving offences so it might be a good idea not to keep trying to justify them.

Why is this so hard to believe??, this is "the partner" yes what you read is correct, my self and my partner had that exact combined income- hard as it might be for you to believe.

If you read the post correctly you can just about puzzle it all together - after i got signed off from work (which i gave up because i was signed off for a year, having lithotripsy treatment on my kidneys) No employer is willing to keep on paying you sick pay for a year without a signed contract first. My mistake as i should have signed one.

We did live 36 miles away from a hospital and also 6 miles from a shop - it's called living in the countryside.

No my partner never thought it was a "good" idea but having never really gone through a situation like this before - we were not aware that you could claim so many different benefits, like he said we have always worked and payed our own ways in life.

French insurance is perfectly legal in this country - even if driven by an english person! the time frame being no longer than 6 months then by this time you would have to purchase english insurance, seeing as we lost our car a few months into our nitemare beginning this was i assure you "perfectly legal".

No the local MP or SOS for DWP were willing to sort this out - yes even Peter Hain himself couldn't sort this out - apparently this happened a lot while Mr Hain was SOS for DWP (Fraud i think they call it......)

No i can quite assure you there is nothing more to this than we are telling you. it really is the truth.

    Erm?

I'm starting to wonder about this thread. You had a £36k job and your partner had a £16k job. You live 36 miles from a hospital and 6 miles from a shop. You thought it would be ok to drive without insurance, and having been caught, then thought it would be ok to drive on your mum's french insurance? And your MP and even the Secretary of State for DWP couldn't resolve the problem? That suggests that there's more to this than you are telling.

    Refering to the below...

You would have thought this wouldn't you... but no apparently they arent that helpfull.

MPs being involved usually sorts out any administration problems very very quickly.

I think that either you need to give a clear timeline of events, i.e when partner finished work, when you finished work, when each benefit was claimed, when the MP got involved, when hain got involved etc oh and what you meant by the comment above, otherwise people will just be trying to guess what's gone on, and what you can do about it.

    Again reffering to the below...

Yes i did "go off sick" in January 07 with a kidney condition that really affected my day to day activities and still continues to do so, until you go through something as terrible as we did you wouldn't even begin to imagine the day to day !!!! that we went through, and yes i did manage to have a baby after 11 months- i had to have him by ceaserian "c section" because i couldn't have him naturally. how dare you be so rude.

hopefully this never happens to you but if it did only then will you ever go through the same crap as we did and for so long - we lost everything and when you have everything and then loose it in such a way that it leaves you feeling so rotten and !!!! - not caring if you woke up on the morning couldnt give a crap about day to day stuff, or anything else

until then you might want to consider somebody else's feelings before you say crappy things about their life.

Oh and your wife went off sick in jan 07, with a kidney condition that you believe should get her IB and DLA and was so severe that you had to give up work to care for her but also gave birth some 11 months later?

I'm going to reserve judgement on this as when I was Health Visiting I regularly saw situations where a family were devastated by illness. Not all hospitals have the Pals service-it can be hard to access these days and often families are put under tremendous pressure to provide their own tranpsort in this day and age. Whilst I don't condone breaking the law whatsoever I can sort of understand it here rather than just general driving around but yes it is wrong. As for the snide remark re the baby-this is not at all unusual,do none of you ever read the newspapers where babies are born whilst their mothers are critically ill? Anyone with severe Kidney disease would be advised to avoid pregnancy due to the extra stress on the kidneys,ad to not take proper precautions is reckless. However I myself pushed to get pregnant whilst I was facing a total colectomy-I honestly thought it might be my only chance to have a baby,I was on horrendous medication, was very sick and a trained Nurse-but logic flew out the window! I was lucky that after several miscariages I was successful-and in fact the pregnancy had a very beneficial effect on my illness.
If it is a windup it's unbelievably complicated and I hardly see the point?
Tomorrow is always fresh, with no mistakes in it!

I was working last night so haven't been checking back but was kind of hoping this thread would have made some headway by this morning!

I had my suspicions tbh. For me it is their persistance with the insurance issue and the post about druggies having everything handed to them on a plate that seem 'trollish'. And last nights responses are also in this league.

But having caught up with the thread this morning, I am now wondering how they are getting to the hospital now and also how either of the 'crushed' or 'taken' cars were sold to help pay the bills?

I may be wrong though. OP (or partner) - you really need to clarify some points if you want decent advice.

ETA: it does say the partners car was sold. So does that mean one car was crushed, one car was sold, and the other was brought over from France but also taken by the police?
