  • Thanks to the OP for spotting this - I had thrown it all in the recycling bin without reading (cue mad hunting for it with my legs sticking out the top last night). Rang up to place an order last night and after explaining about the voucher the lady offered for a manager to call me back. This duly happened a few minutes later and the manager asked me how I had interpretted the offer - when I explained that it was £39.99 a case and then a £30 discount she agreed to honour it and took all my details (including Nectar AMEX card number - loads of bonus points) and said it should be with me in a week. Also took my email so they can email me with progress of the order and no doubt loads of junk. A cracking deal - thanks again.

    placed mine yesterday, havent had an email, or i cant track it online! havent even had a reciept or confirmation of order.i am going to give them a ring to find out when its likely to arrive as im on hols next week!
  • actually first of all the club is based in a call centre in plymouth, the mailings just go to an address in reading. and as trading standards states until the exchange of monies has actually taken place they are allowed to withdrawl the price at any point even if advertised differently. so actually they're not doing anything illegal. plus they have now started checking the database for people taking up the offers to check they were actually on the mailing list, so if you haven't recieved the voucher then you wont be able to order it. plus aparently theyve not stopped honouring it after a meeting with trading standards, as i have tried now 3times under different names etc

    ok just rang them! seems they have been inudated with this offer as now there is a prerecorded message, saying there could be a delay due to the overwhelming populairtiy of the £39.99 offer! any way she said orders are picked on the day of order, and takes about 4/5 days to customers so should be late this week early next.

    It said that right from Saturday, so I think that's just normal sales hype to make you think it must be a great deal as so many people are calling and you had better hold on so you don't miss out! (At £46.98)

    Well actually I'm not so sure of that.
    My understanding of the Consumer Protection from Unfair Trading Regulations 2008 Schedule 1 is that it prohibits bait advertising where a traider lures a customer to buy a product at a low price when the traider is aware that he is not able to supply at that price in the knowledge that they will be likely to still buy the item at a higher price once their misunderstanding has been explained to them very nicely.

    I guess they will use the defence that it was all unintentional and they didn't really intend to entice loads of people to call for a the deal at £16.98 only to find lots of them will still pay the £46.98 when it's been explained how silly they were to have "miss read" the voucher.

    Trading standards will no doubt have little choice than to let them get away with it as long as they don't do it again too soon. I suppose on that basis they are allowed to continue with their offer and explaining their version of it to customers so long as they give in to those who aren't buying the explanation and as those are a drop in the ocean, pretty much everyone's happy.

    The advertising agency will sell it's services to the next buisness they target using the graphs of customer takeup peaking with the success of their masterful July mail shot... Oh dear how very cynical:rolleyes:

  • Laithwaites/Direct wines is raking loads of cash in from this offer anyway, it's a big big company and with the demand for the wines are sure to run out of stock before the end of august inwhich they can stop supplying the offer, lol.
    so least your keeping a company in buisness in the credit crunch
  • I still can't track my order, but £16.98 has now been debited from my card.

    Interesting. I got a call back and they will not sell the wine at the reduced price and offered me £15 off instead. Said I would have to think about it.
